Bum Hip - gundy1907 - 04-21-2008 11:35 PM HELLO EVERYONE, I HOPE ALL IS WELL. FOR MY WIFE IT IS NOT THAT WELL, AND I'M HOPING THAT SOMEONE CAN GIVE US SOME GUIDANCE. ANYTHING WILL BE APPRECIATED. MY WIFE AND I LIVE IN WISCONSIN. MY WIFE HAS BEEN AT HER COMPANY FOR 4 YEARS. SHE HAS BEEN A STAR PLAYER FOR THEM, AND MOVED UP IN HER DEPARTMEN BASED HER HER PERFORMANCE. IN DECEMBER OF 2007 MY WIFE SLIPPED AND FELL DOWN THE STAIRS AT WORK SRIKING HER HIP AND TAILBONE AREA. SHE FOLLOWED PROPER PROCEDURE WITH HER COMPANY. THEY THOUGHT SHE BRUISED HER TAILBONE. SHE DID THE REHAB FOR 2 MONTHS. THAT DIDN'T WORK TO STOP THE PAIN. SO HER DOCTOR SENT HER TO AN ORTHOPEDIC SURGEON AND TO GET AN MRI. IT WAS NEGATIVE BUT STILL PAINFUL TO SIT. SHE WENT AND GOT A SHOT UNDER AN XRAY(FLOUROSCOPY). THIS PROCEDURE WOULD TELL IF IT WAS HIP RELATED PAIN OR ANOTHER PART OF HER BODY. THE RESULTS INDICATED IT WAS THE HIP. THE SURGEON THEN WANTED HER TO GET AN MRI WITH A DYE INJECTION, BECAUSE IT WOULD SHOW MORE DETAIL OF THE CARTILAGE THAN THE REGULAR MRI. NOW IN THE MEANTIME, IT IS HARD FOR MY WIFE TO SIT FOR LONG PERIODS OF TIME, AND SINCE HER JOB IS CUSTOMER SERVICE, THE SURGEON PUT HER ON 4 HOUR DAYS WITH THE REST OF THE DAY BEING PAID BY WORKERS COMP.THIS PRESCRIPTION WAS INDEFINATE. I DON'T THINK HER COMPANY LIKED IT, AND I KNOW HER WORKERS COMP DIDN'T EITHER, BECAUSE THEY SET AN APPOINTMENT FOR AN INDEPENDENT EXAMINATION WITH THEIR DOCTOR 3 DAYS AFTER THE INJECTION MRI WAS DONE. WE HAD NO PROBLEM WITH THAT. WE KNOW IT IS PART OF THE GIG. ON FRIDAY, AFTER INDEPENDENT EXAM THE ORTHOPEDIC SURGEON CALLS TO SET AN APPOINTMENT UP FOR WED OF THIS WEEK TO DISCUSS THE MRI INJECTION RESULTS WITH MY WIFE. TODAY MY WIFE TALKS TO HER ADJUSTER AND SHE SAID THAT THEY CLOSED THE CASE ON FRIDAY AFTER THE INDEPENDENT DOCTOR MADE THE DETERMINATION THAT MY WIFE HAD HEALED ENOUGH. INFACT HE SAID THE HEAL DATE SHOULD HAVE BEEN MONTHS AGO. THE KICKER IS THAT HE MADE THIS DECISION ON THE OLD MRI THAT WAS NEGATIVE AND OTHER INFORMATION. WHEN WE FOUND THIS OUT, WE PRESSED THE ORTHOPEDIC SURGEON NURSE FOR A COPY OF THE NEW INJECTION MRI RESULTS. THE RESULTS READ...FINDINGS CONSISTENT WITH AT LEAST POSSIBLE LABRAL TEAR IN THE ANTERIOR AND SUPERIOR LABRUM. WE IMMEDIATELY WENT TO HER PRIMARY CARE DOCTOR AND HE TOLD US THAT THIS INDEPENDENT EXAM CANNOT END HER CLAIM, AND THAT SHE SHOULD FOLLOW THE SURGEONS WORK RESTRICTIONS OF 4 HOUR SHIFTS. WE CALLED THE WORKERS COMP ADJUSTER AND TOLD HER THIS AND SHE SAID WE DIDN'T KNOW WHAT WE WERE TALKING ABOUT. MY WIFE WAS FIRM WITH HER AND SAID SHE WOULD FOLLOW THE 4 HOUR WORK RESTRICTIONS THAT WERE GIVEN TO HER.THEN THE ADJUSTER SAID THE INDEPENDENT DOCTOR SEEN THE INJECTION MRI RESULTS AND CONCLUDED THAT MY WIFES INJURY WAS PREEXISTING. THAT STATEMENT INDICATES SOMEONE GRASPING FOR ANYTHING TO MAKE MY WIFE QUIT ROCKING THE BOAT. WE CONTACTED A LAWYER AND ARE WAITING FOR A RETURN CALL. MY QUESTION IS WHAT WILL HAPPEN NOW. COULD SHE LOSE HER JOB BY NOT GOING BACK TO THE 8 HOUR SHIFTS AND STAYING ON HER DOCTOR PRESCRIBED 4 HOUR DAYS. IF SHE GOES BACK TO THE 8 HOUR DAYS AGAINST HER DOCTORS RESTRICTIONS WHAT COULD HAPPEN HERE. SHOULD WE LET THEM KNOW THAT WE HAVE RETAINED A LAWYER, AND IF SO, WHEN SHOULD WE TELL THEM AND WHAT SHOULD WE EXPECT. I GUESS I'M LOOKING FOR ANY HELP. THANKS GUNDY RE: Bum Hip - Tuffy - 04-22-2008 12:06 AM Usually after you retain an Attorney all communication between the injured worker and the WC ins co stop and the attorney handles it/ Yes she could be terminated, and if she returns to work and does not follow the treating Dr restrictions it could effect her claim. My opinion is follow Drs orders, and let the attorney handle it from here on in. There are others here that will be along and may be able to offer more. What state are you in as WC is state specific. RE: Bum Hip - sparkey - 04-22-2008 04:42 AM Gundy, you said that your wife heard within a week about the IME results and they were NOT to her advanatage. I am still waiting on my IME which was on the 3rd of this month and still have not heard a word. I am praying that hopefully this is good news for me, as i have not heard anything yet and they ( IC ) may be thinking what they should do next for me. So was this within about a week that you hear about your wifes IME results??? I am keeping my fingers crossed that this is a good sign for me possibly having the IME doctor agree with my injury. I called their office yesterday and said the doctors office was closed. I will try again today. I wish your wife luck, and wish i had answers for her, but she does have to work within the doctors restrictions or she could possibly injure herself more.I wish her the best. STAY ON 4 HOUR SCHEDULE, AND WAIT TO SEE HER ORTHOPEDIC SURGEON. Although Your Wife likes Her Job and Wants to keep it, which is Understandable, She Must Follow Her Dr.'s Orders of 4 Hr. Days. If She were to go back to 8 Hr. Days, She is going to cause Harm to Her Claim, and give them More to Use against Her. If Your Attorney takes Your Case, follow All of their Instructions, and Document, Document, Document!! It's amazing how much You will need Info. later that You are getting Today! Ask for All Copies of films and Dr. Reports, even if You have to Pay a small amount for them, I have every MRI Film, along with the Reports that accompany them. and I have Used them in My Case! I Wish the Very Best for Your Wife, and Please keep Us Informed!!
