Overpaid Workmans Comp- Can they take it back? - Kaity8891 - 09-24-2016

My fiancee was on workmans compensation for hurting his back. We recieved his first check 2 weeks ago and She told us it was $1700. I told my fiancee that it was wrong and he talked to the lady and it was insure incorrect. She told us that we should not have said anything because they would not have been able to take it back once they had paid us. We just received his last and second check and found that it too is incorrect and is for $1700. She told us last time not to say anything so we haven't.

My question is can they ask for it back? We put it in our savings in case they do. We live in Illinois, not sure if that matters. I have tried looking up the legal-ness for this but have not found anything yet that is definite.

He won't be receiving any more checks but I wasn't sure if his company could deduct it from his checks or if the workman's comp could contact us saying we owe them. And how long do they have to ask for the money back?

Yes they can request repayment of any amount over what was owed.
I'm not aware of any legal time limit.
Who is the "she"?
