I am in ny

I am going to court soon to convert what started as STD to. Workers comp case now my fmla is just about up and I am being paid STD through my job would it hurt my case if I am back to work before the court case is heard I know you can be fighting a case while being employed by the company . I am going for an esi and if I feel I am better would be in my intrest to o back or not

i don't think it matters what happens afterward.
many end up back at work after their claim.
the sooner you return to work, the less financial loss you have.

My advice from where I stand now as completely disabled, and unable to work suffering severe depression is "IF YOU ARE ABLE TO WORK AT ALL DO IT" humans are social creatures who NEED outside stimuli, not working is basically unhealthy. I cannot express what would give to have a "purpose" again. Best of luck to you, and I would also ask my attorney's advice.
