I want to say thank you to 1171 for the link to the fact sheets. They did shed light on alot of my questions. I guess what I am still puzzled with is this:
1) I want to protect my job and any future job, and I am very concerned with this final examination, will it jeapordize my future jobs and current job with the doctor rating me showing a disability of whatever percentage, and if he would impose work restrictions or not, even though currently I am under no restrictions to work. 2) If I go through the process and for example I get a 10% rating and open medical, does that mean in the future if I have any problem relating to my injury, WC covers it and would theywould also cover time off from work because of it. 3) If I do nothing, no exam, walk away, if I have any problem in th future from my injury, workers comp wouldnt pay for it and would my own insurance???

The entire WC thing really scares me. I never filed this claim, my employer did because it was a witnessed event and I am the only source of income for my family so it really scares me to think that possible some doctor who gives me a rating will cover himself and give me work restrictions and that would result in me losing my job, yeah that would make the claim bigger but that wouldnt take the place of income from working. I just dont know what is the best option here. I really hope that this injury wont preclude me from working in the future but nobody knows what the future holds. Please advise...

I can't predict an employers response to a workers PD rating.
why don't you discuss it with your employer? if the employer has any doubts they can request a fitness for duty evaluation. you could also take a job description to the doctor at the time of the rating and have them ok your duties

yes, treatment for the injury is covered. as with anything there could be a dispute about it's relationship to the injury.
temporary disability is limited to 104 weeks within 5 yrs of the date of injury.
aggravations are considered a new injury and you can file another claim.
most other insurance excludes workplace injuries unless it's denied by workers comp so yes they would cover it with a work comp denial.

When I was injured I was off more then a year. Dying to return I asked my dr to release me to full duties for only my job description. Work was satisfied with it and so was the dr at that time.. The only problem that evolved was even though my duties never changed but the amount and pace increased. With that being said, I reinjured my back and was taken off work. Since then it has been a battle with employer and wc saying I am able to return. Now I have no income and is being ran through the court awaiting the date.

I say this just to warn you of what could happen if you are returned to work with no restrictions........ Good luck.

Thank you for sharing your experience through this...it is alot to think about and consider, it makes me darn mad that this happened in the first place...i have alot to think about.
