Hi, Iam probably asking the same question over again, but I need an answer if possible. Shoulder surgery.My Dr said no more treatment available. Fired from job. IME says return to full duty.(Havent seen report yet) maybe no restrictions. Job says no, you werent fired. If I have to go back (it will mess my shoulder up more) will I be a new hire w/pre-existing? Will I be able to get treatment for pain and damage that will be for sure to come? help!

if you weren't terminated, then you are entitled to return to work; but you aren't required to.
if you are injured again, you can file a new injury.

Thank you. The thing is, I was fired ,the unemployment said I was discharged, but the company said my job was pending dr. Isnt that fraud on co part? If I dont go back I wont get TTD. If I go back and quit cause of pain no unemployment. Any comments? Thanx again. I am glad theres a forum to at least vent!

your issue is confusing.
I may have misunderstood.

your concerns make it appear like you resent not being on unemployment or disability and are upset that your employer is willing to take you back.
your seem to have a great fear about returning to work.
I think you were scared when the doctor said no more treatment.
you seem to be trying to put off or avoid the end of your injury.
have you discussed this with your doctor or atty?

some information may be missing here...
are there others factors with your injury or your situation that are contributing but you haven't included in your posts?
are there some emotional or psychological issues with ending your claim and returning to work?
I'm not sure this board can tell you what you want to hear.

if you do go back you also are not eligible for TTD
