Question about w/c and vacation pay - frustrated w/ work - 09-30-2010 11:59 AM

have been off work for 4 weeks now with no pay at all from anyone and still waiting for my corp office to send my adjuster needed earning /wage statement .My question is can anyone tell me if I can draw my vacation pay with out it affecting my W/C

I don't know your employer policies, but my employer used my sick, holiday, and vacation until my wc was approved. Then they reimburse me the hours that were used. You need to call your employer. I hope u ate able to get it taken care of.Big Grin

vacation and leave usage is set by your employer and not controlled by workers comp.
generally yes.
you can send in copies of your check stubs or w2's

When I was injured my employer was right on top of things and it sounds like he is dragging his feet. My nephew went through the same problem 2 years ago and all he did was get his last years w2's and gave his last 4 pay stubs. And the ins (wc) went off those and all was ok........It shouldnt conflict by trying to get your vacation pay, that is back money owed to you and infact for some reason you dont return to work a lot of employers try to screw there workers from thier vacation pay.... So might be a good thing to try to draw it if your employer alows it....

I called my state's W/C office and they told that yes I can draw the vacation pay but that it would be concidered wages and I would have to pay back 25% of it to my company .

good for you. each state has it's own work comp system and rules. all are different.
we can only give general answers without knowing your state.

thank you for trying to help me. It seems things have all of a sudden been settled after I called. My adjust all of a sudden found the paperwork and put in a request for a check I should have in a few days .
