Hey everyone, well I got fired from my job yesterday for "not returning to work full duty within 180 days of the injury"
, What are the legalities of this...it is a workers comp injury and I am still being treated "awaiting another surgery on my left shoulder"
They have been poroviding me with light duty work up until yesterday when they decieded to fire about 7 light duty people.
So my questions are, is this legal for them to do? who has to pay me?
Iam basically lost on what to do, and what they did if its legal or not.
I am a California worker.
All advice and help appreciated.
1171 is from california and knows tthe system well..be patient and im sure he will be along to answer your questions shortly..and you can always send 1171 a private message
i assume you were on partial disability and not permanent and stationary yet.
if so, and the employer can no longer supply light duty, your temporary total disability will be restarted.
make sure your carrier is informed of your job status.
workers comp laws don't require that employers hold a job or make a new job for you.
