Full Version: WC has not paid me.

My WC doc put me on modified duty on 10/29/09 for 30 days and WC, even though they have received all of my paperwork, have not paid me. It's time to go back to be re-evaluated next week to see if I am to continue this modified schedule. My job has paid me for the time I have worked, but that's it. My attorney said that they are asking for an immediate hearing to see why. Can they just not pay me even though the doctor put me on this schedule? WC have never had a problem paying me in the past. In 18 months I have only been off a total of 7 weeks. What's the deal? By the way, my claim is in Washington, D.C. and I recently found out that my back is not a limb, and DC only pays for limbs. The pain radiates down my legs, hips and feet. I have 2 annular tears in my L4 - L5 and L5 - S1. Also, I have been diagnosed with sacral damage and spinal stenosis. I am a business manager for a hospital and oversee 4 offices and 2 of them are off-site. I have to constantly move and drive which makes my situation worse by the day[/color][/size][/font]. Sad to say but they probably can get away with not paying you atleast for some period of time. I was paid TTD off and on when I would have something done and needed to be off for a few days and after my doctor wanted to do a SCS they decide it was not a WC injury and stopped paying it under WC they put me off work saying they had nothing I could do with my restrictions now for almost 2 years. I had a hearing last Nov awarding me WC, they appealed and had that hearing in July of this year. I won that and they still are not paying me under WC. My lawyer is working on it but there is so little they can do to make them pay. Laws need to be changed but nobody seems to hear us
oh wow dmma i had the same exact thing tears at l4-l5 l5-s1 and had to have a 2level fusion have they offered that to you??

No one has offered to do anything. I will be going to to see a NS on the 9th to figure out what to do. On a good note, WC will be paying me. I hope to get some answers soon. Thanks.
be aware that fusion will not work for a tear. There is zero evidence to support it's use.
thats what the dr did for me a 2 level fusion for tears in 2 disks he said it would eventually rupture again with the heavy type of work that i do as i was willing to try anything to keep from going through that pain of a rupture again

with my fusion they totally remover the disc's and put spacers in with screws and the bone is supposed to fuse in and around the spacers. L4-5 and L5-s1 were done and L3-4 is weak and has a tear.
