Hi ,
My atty tells me that i won't be getting any award as i've already been paid in periodic checks from the date of my injury upto- MMI.
is that right?
Confused
if your award amount has already been advanced then the only award payments that may still be due are for atty fees.
a formal award for disability and medical treatment will still need to be issued by the comp court.
your atty knows the facts of your case and is in the best position to provide detailed information on the status of your benefits.
I'm not Sure of Your State, but if You have Healed, and MMI with Little or no Restrictions, then the w/c System has done Their Job, and You are not going to get any Type of Settlement as You are Healed! Now if You have a Permanent Injury, and Signed an Agreement that Your TTD Payments were Towards Your Settlement, or Your State does it that Way, that could be a Possibility also. I am Totally and Permanently Disabled and Left Unable to Work, and I'm Still Fighting after 5 Years, 15 Hearings, and 2 Appeals, and I have Won 14 1/2 of the Hearings, and the Appeal!! It's Very Complicated, and if You gave Us the State You Live in, and Your Injuries, Someone from Your State may be able to Answer You Better!! My Very Best!!
cud u clarify this a little more.i was paid wkly chks( ttd -tpd? )from 9/08-5/09.
I hv a scheduled loss of use=20% from the ic doc,45%from my doc?
So,how does that add up?
I know my atty should explain this to me but i just cringe at the thought of even talking to him.He is such a rude .......!!!
Thx.
My Suggestion and Opinion Only, is to make a Set-Down Appt. with Your Attorney, and make a List of All of Your Concerns to Discuss. I have seen so Many Situations over the Years where the Attorney will Speak to Someone in Their Lingo, and the Average Injured Worker can't Understand it! By Setting Down, You can Voice Your Concerns, and if You are not Satisfied with the Responses or Answers You get, Ask for a Complete Copy of Your Records so You can Search for another Attorney! Usually when there are 2 Different IRE Disability Numbers, Your Attorney should have Filed for a Hearing for the Judge to Review both Dr.'s Reports and come Up with a Figure They Feel is fair! And if You and Your Attorney aren't Happy with that, there is the Appeals Process also!! I have not had to Deal with IRE Ratings Yet, but I Surely have had to Deal with a lot of Issues during My 15 Hearings, and My Dr.and I were Found More Credible in a 52 Page Decision from the W/C Judge!! And I was, and Continue to get My TTD paid Bi-Weekly while We are going through the Second Appeal, I Won the First Appeal, but the Judge wasn't Happy with it, and wrote a Rebuttal to the Appeals Board, and We had Oral Arguments with the Appeals Board a Couple Weeks ago, and We Asked the Board to Affirm the Judges Decision, as We need My Case Officially Closed so I can take it to the Commonwealth Court, outside of the w/c Arena. With any Luck, I will Expand a Law that will Help Many Injured Workers in the Future, and Force My Employer to Pay Me My Back-Pay of over $200.00 per Week for the Last 5 Years, and They will have to Pay Interest and Penalties for Them Paying Me the Wrong Wage for so Long!! As You can See this is Long, but only One Facet of My Case, and I have a Attorney that always Calls Back, and Spends Usually a 1/2 Hour Per Call Explaining and Answering My Questions. Fight for what's Yours if it's Available, even if it Means Choosing another Attorney that will Fight for You! But the First Step is to try and Find Common Ground with Your current Attorney, and get Your Questions Answered!! Best of Luck, and I Hope this has Helped a Bit!!
