Full Version: Question about hearing in PA?

Hi, we are in PA. My husband had his hearing in Sept for the defense to present their evidence and we were told that was it, both sides submitted their briefs and we received an e-mail from his attorney stating the case was closed and now we just needed to wait for a decision. Last night we get a letter in the mail stating there is another hearing in the beginning of December??? I called our attorney and spoke to the paralegal and they did not receive the letter yet and don't have anything on their schedule... She said a decision will come in the mail, we thought maybe they had made a decision and that is what the hearing was for...

Can anyone offer any idea as to what might be happening? Do decisions always come in the mail? She seems to think it was a mistake? Could the insurance company requested another hearing?

I'm from Pa. also, and without knowing what the Letter Stated as a Reason for the Hearing, it would be Hard for Me to Give You an Answer. Somewhere on that Letter, Usually there is a Section of Reason for Hearing. If I had that Info. it would be Very Helpful. The Judge May Need More Evidence, or Possibly the Defense is trying to Add Evidence. Either Way, I would need to know what it Says!!Wink
yes court decisions have to be in writing and served on all parties.
either party or the court can request a hearing.
your atty can find out who requested the hearing.
I pulled out the letter b/c my husband didn't know where to look and was saying it didn't say anything..

Under Petitions it says Claim-Pet. That is it.

Is that any help?

Are you sure no where on this is there a decision on the claim petition? The reason I ask is the way you are describing this, and I am picturing all if mine, Saying claim petition under petitions should mean that is the only petition that has been filed and if there is another date set I would think there is more info needed if another hearing is scheduled but it should be regarding your original claim petition. Is it only one page ? Sometimes there's enclosures. I am also from PA.
This doesn't make much sense to me. If either side had requested another hearing, they would have had to copy the other side, so your lawyer would know about it. It would be very unusual for the judge to just schedule an additional hearing after the record has closed. I tend to agree with your lawyer that this sounds like a mistake.

Thank you everyone, apparently it was a mistake and the hearing was cancelled.. The funniest part was we received our decision in the mail yesterday, the same day we were thought we were going to have another hearing... The judge found in our favor and they are to reinstate my husband to workers compensation and pay him all back wages for the past 16 1/2 mos!
