Hello everyone. Finally get to see choice of dr.(neurologist) for second time since 4-08. Lawyer mentioned to me thurs. gone that ic and their lawyer would like to discus settlement after visit. cash and release I believe. Any suggestion. Will be back shortly. Thanks. In La.
What has your attorney said about this? Is he going to contest this or does he agree that it is time to settle...of course it would depend on what your doctor says as well.
I hope that your attorney is really skilled and can get the best settlement for you.

Made it back. Okay. IC finally approve this visit after 1-1/2yr.. This dr. sign off on mod. work order from voc-rehab. rep. for ic. I don't know if she knew that other recom.(diagnostic,PM, depression counselor) she listed on her eval. report was never done. I was told to report to work on 10-08. Didn't go. Constantly requested visit with dr. denied all the time. Payment stop then. It took almost yr for IME to summit his report. Incomplete at that. Have now copy of ncs/emg and MRI of injuried area(cervical). I need her input on my present condition. Such as treatment suggestion,permenant damage or not, suitable to work or not,was able to do mod. job or not. The stroke of her pen will determine my future. Any suggestion on how I shall go in there? My lawyer said everything depends on me.Dealing with w/c is all he does. He has dealings with ic lawyer on opposite side of table. He is not as aggressive as I would like. But he has shown me , to be patience. After the visit, he will let me know what my options are. I'm looking for an closure to this crap.Thanks.

The Only Suggestion I can give is to be Honest, and be Clear on what You are looking for! Remember, Everyone in that Room is the Same as You, They put Their Pants on One Leg at a Time!! It will be Stressful, just Follow Your attorney's Lead, and Patience is Something Needed when Dealing with w/c!Wink

Hello. Went to dr. Tuesday. Dr. chose to consider one of 2 diagnostic test done.EMG/NCS of upper extreminties. Dr. whom she had studied with. Carpal tunnel of both hands. Irratation of nerve root c6-c7. She noted that this test was not included in IME report. She also noted that job analysis report sent to her over year ago,in which she signed back then,she wasn't informed that her recommendation for testing, and PM wasn't done. She stated that she will include in her report that she do not approved the modified position. That she do not want me doing any type of labor job. Maybe secartary work. But no janitory. Do you all think this will get me back pay?. Do I considered settlement talk now? Or what route shall I take now? Any sugestion? Thanks. She also stated that I will be dealing with my neck issue for rest of my life. Myleogram would show if any nerve root is damaged.
when you get the doctors opinion file for a hearing. they won't settle unless it gets them out of going to trial.
Hello everyone. Rec'd report yesterday. Called lawyer,one of the things he asked me was-How did I get the report? The report stated:Impression-1)Chronic neck, shoulder, and arm pain related to on-the-job injury. The pain is most consistent with myofascial and musculoskeletal pain. 2) Peripheral polyneuropathy and possible radiculopathy by history. These diadnoses were made by EMG/NCV studies.This is a very subjective test. 3) Depression. Although I am not a psychiatrist, the patient appears to be quite depressed. Recommendation: The patient is not able to return to his previouswork duties. He needs rehabilitationfor a sedentary job. This disability, though partial, is permanent. I have nothing to offer this patient. I recommend pain management evaluation and treatment. Question- Does PM Dr. become my choice of physician now? Could I be instore for back-pay? Could my pay be started back up? Lawyer will called back tomorrow to discuss option. He did say that IC is willing to talk settlement. If I settle now, it will not be as high as it would ultinate be. 1171, you say for me to ask for a hearing. Should I still do it? Can the IC lawyer object to this? What should do? Anyone with experience at this stage? Could you suggest? Thanks.
if the parties can't agree on a settlement amount the only option left is a hearing to let the comp court decide; so yes going to court is always an alternative while the claim is still unresolved.
i don't know about your "pay" but temporary disability benefits terminate when maximum medical improvement is reached. the doctor says you are permanent and not temporay so re starting TD is not likely.
your atty should know whether their offer is reasonable or not. if it isn't then you should consider going to comp court and let the judge decide.
