The attorney for the insurance company sent my attorney a letter in the mail.
Seems they were under the impression I was receiving active treatment from the work comp doctor's on the back/carpal tunnel and right knee.
What is funny about this letter is I have been waiting 11 months on the judge's decision granting medical treatment for the above.
And my primary doctor (osteopath) has put in writing, the ulnar nerve entrapment is linked to the use of the cane.
The letter goes on to say the TTD payments have stopped due to not participating in active treatment.
Now they are seeking credit for the TTD paid after I reached MMI.
kinda makes you scratch your head and go huh??????????????? doesnt it?
My TTd tried to get credit for payments but they did not get them back as my lawyer told them that wont happen and had it written in the wc settlement that I would not pay it back.
What was Your Attorney's Answer to You, and what are They going to do about getting Your TTD Payments Re-Instated!! Apparently the Attorney for the Ins.Co. has not been keeping the Ins. Co. Informed, and Your Employer is Most Likely in the Dark also!!
This is kind of scarey. I probably spelled that wrong. Too much time off, brain dead now. I had a copy of a letter from the i/c to my surgeon telling him that he was being unprofessional and that they wanted to know, once again, if I was at MMI and what my restrictions are. This after my surgeon has written several times telling them that I needed home help now and that only surgical intervention gives me a chance at getting back to work....otherwise I am, in his opinion, permanently disabled. I don't know who is playing the stalling game. But my surgeon has already stated that as time goes on, that my chances of getting back to work grow slimmer. Maybe they think that if they write enough times, he will get frustrated and give them the answer that they want. I have no idea.
exactly what they think and want Bag and the bad thing is most Docs soon do it just to be rid of the problem...mine wasnt one of those and I hope yours isnt either
Bag the insurance company is trying to pressure your doctor to place you at MMI early. They also did this with my doctor and my doctor held his ground and refused to place me at MMI early.

The insurance company's attorney also wrote in the letter that I have no work restrictions that keep me from working. I do have work restrictions typical for a knee replacement, and my employer refuses to provide work accomodations.
I have sedentary work restrictions from my primary doctor.
Still In Linbo, I have not spoken to my attorney about this letter. I have decided to scheduled an appointment to see him in his office and talk about this.
I feel I am being penalized because the judge has not made a decision on treatment
and according to the insurance company because I am not in active treatment the TDD stops.

I am extremely lucky. My surgeon is one of those who gets seriously angry with workers comp insurance. And he has written to them stating that their treatment of my case seems to be boarding on harassment. I have to say, I was surprised. He has written a few letters to them letting them know his thoughts. I am sure he won't back down. In fact, in his last letter, he stated that I had his full support and that they should know that. I am actually thinking that this is why they have written the letter. I think he seriously pissed someone off.
An Update..........
When I last spoke with my attorney I share with him about the ulnar nerve entrapment and asked him, "What can we do to get my case moving"
It was decided to have my family physical write a letter listing treatment needed with the relationship to the original injury. With additional medical evidence included with the letter.
(A previous letter written by my doctor was the deciding factor in the judge approving the knee replacement)
Upon reviewing the neurologist written report of the upper right EMG & NCV findings:
the report documents that I have moderate wasting of specific muscles of the right hand.
My doctor tells me; "Once wasting occours you don't get it back"
