i am in NY

I have been out of work 5 months, had IME 9/24, IME, says I can return to work sedentary lite lifting. My employer has no lite duty. My employer has been paying me full salary. I get fed ex notice today saying alot of what their IC says , but I need to give back company car, cell , phone etc. I call back to work coordinator for my company, and she says after a certaian amount of time they do this, they have put me on corporate leave, which means that I am still with company on their books for another year, but after 11/29, the payroll from my job stops, and i go through their IC for workers comp, Now for the next month they will be taking out car allowence, so I dont understand why they would want the car back right away. She say that when im released back to work if my job is available fine if not i would have 12weeks to find a job within the company. Now, she says if I get a note from my doctor saying that i can come back full duty then fine, she says that in my case that i should only come back if i am truly in back to work condition because i could make the situation worse,because the doctors concur with diagnoses i said but i do not want to lose my job. Now my IME doctor agrees with my doctor about the lite duty mild partial disability. it has been a month since i saw my doctor, im do to see him in a week, i feel so much improved, I feel i could do full duty and want to go back............whats your thoughts, sorry about the lenght of thread

what are your injuries if you dont mind me asking and have you had any kind of surguries??

L5 S1 Problems more nerve oriented, numbness pain right hip down leg to foot, Ic Report says MRI HNP
No surgeries I have had 2 epidural, schedule for third Nov, I am improved I feel to the point of full duty, dont want cut in pay or possible loss of job?

shouldn't be a problem to go back to work then

Mine is too, it has gotten so much better, i still have some pain but it is so much better,

if i return to work im feeling great, and i reinjure myself same spot or problem, can i reopen case or make a new one.

one more thing

if i had previouslt sheduled treatment prior to my return date, do i still go, does wc pay for that

i have been out for 5 mos l5 s1 radiculitus, im feeling great, and ready to go back, pain mgmt doc will agree, i have had 2 back injections, they say they usually give three, if i return to work full duty, will my employers third party ic pay for this, the procedure was approved before we decided to go back to work

everyones different but I had s1 l5 problems. I had two surgeries and had my back fusion. I first had the disc removed in 07. I was 33 when I got injured. I had surgery 12-07 went back to work 2-08. I fought to go back against everyone. I had back fusion and a nerve decompression done on 11-08. I have drop foot for the rest of my life now. I fought to go back as fast as I could. Went back 3-09. I got pulled out of work a month ago. I will not be returning now. It made my problems get really bad. I am a city bus driver. So King County has 6 months to find me another job that I can physically do or they can send me to school for two years and pay me for that time. I hope I get to go back to school. I have had physical jobs my whole life. That is what I like to do. Now, I am looking at a office job. Never done anything close to that before and I am not sure if I will like it or not. I hope I will.
Anyways, I am saying be careful about going back to work. Go back if you really feel you will be fine. I thought I am tough and I will get through this. But my back kicked my you know what! I have always been strong, fighter, pain don't hurt way of thinking person. Very independant bull headed, and stubborn person on anything I set my mind to do. This back thing killed me. Pride and the whole thing. One good thing came out of this, I got to see how much I am loved by my family and friends. I also got to see that I need to put them first and not work. This is recent in the last month that I realized this. Thats pretty sad that it took something like this to show me that.

i am in contact with a laywer, and will be giving it a go in a week, will be seeing doc right before i go, I hope to get the last shot while on the job, its only a day thing, but one thing is for sure, I want to be protected. This was more of their fault than mine, that is why this happened, but im a big boy, and i will fullful my job requirements, I will not be performing feats of magic, I will not hurt this situation any further.
