My uncle got hurt on the job. He is out for some time and using his Sick/Vacation time in his absence.
My question: 1. Although he is paid, will Workers' Comp reimburse him for time off from work?
2. Being that it's the first time it's happened to him, (his co. filed the WC papers) what's next for him in terms of Workers' Comp? He was told that he will have to see his company doctor rather than his own doctor. Any tips or ideas will be greatly appreciated.
He can not draw wages from WC and draw wages from his employer at the same time. If his employer wages stop he can capply for temporary total disability through WC if he is not physically working.
Hope this helps you
you didn't give your uncle's state.
yes he can be paid if his disability exceeds the waiting period requirements.
what's next also depends on the state. while some things are generally similar each state has it's own rules.
generally a worker follows the doctor's treatment plan and gets a full recovery. case closed with bills paid by employer/carrier.
tips: have you uncle learn about his state's work comp system.
My misatake i read the original post incorrectly. i thought they were wantin to receive both work wages and TTD at the same time..
OK now I'm confused. Does he or does he not still receive WC as he is using his Sick and Vacation time? The NJ link 2 threads up didn't tell me anything
if your uncle is not working per physician authorized time off work he is eligible for disability payments begining the 8th day of lost time.
the first seven days will be paid once disability extends beyond 4 weeks.
whether he has sick leave, vacation, or other other leave arrangements does not affect his eligibility.
"These benefits are provided during the period when a worker is unable to work and is under active medical care."
