Full Version: Attorney says, "Now I'm Mad"

I spoke with my attorney today and he started the conversation with,
"Now I'm Mad"

He is mad because a decision has not been made by the judge on medical treatment

I am on my 2nd judge, the first went out on medical leave.
And at the most recent hearing I learned the judge could not find my file.

I went to court almost a year ago seeking treatment for the back, carpal tunnel, and additional treatment for the right knee.

I am in the process of having additional medical testing done and the results will be used in court.

My attorney says if we don't get a decision soon then we go to trial.
Oh Bummer I wish you the best Hun. Doesn't it drive you nuts when they just lose something? I hope you take them to court and beat them at their own game.
This is the SAME judge that took 13 months to make a ruling..., gee I'd be mad too. They should be able to reproduce your file, there's no excuse.
The attorney tells me this judge is back to work, to bad she didn't retire.

I went thru my records tonight, the attorney filed for the hearing Oct 08 with the hearing being Jan 09.

This will make almost 11 months I have been waiting for a decision.

My attorney has scheduled a hearing to present new medical evidence.

I learned today we are requesting additional treatment for the left knee as I am again having problems with this knee. The total replacement of this knee was June 08.
Its to bad things are so slow and we have to suffer waiting on them and I wish you the best of luck.
and then you "wait" and "suffer" some more.

I would be quite mad myself if they lost my files. You know that makes no sense at all. God luck sweetie and God Bless. Love ya!

I suppose the system never takes into consideration that perhaps taking months to make decisions is why some people have poor outcomes. Or why other body parts become involved, breakdown, require surgery, etc. Makes sense to me, why can't we convince the judges, lawyers, etc.
Attorney tells me to look for the letter in the mail with the date for the hearing to introduce new medical evidence and to force the judge to make a decision.

If the judge will not make a decision then we go to trial.

I am a little confused, when an IW goes to trial isn't that when they settle?

My primary doctor (osteopath) says about all that can be done with the back is injections and pain management, and I refuse pain management.
How about considering acpuncture? It can help sometimes, my stepmother does it, helps her to be able to function. I've used it a couple of times when I have kidney stones.
