I sustained an injury to my back and claimed the injury was suffered at work and filed a claim for Workers' Compensation benefits. The employer opposed this claim saying the injury, if real, was the result of a congenital condition. In accordance with the statute, a hearing was held before the Workers' Compensation Board, which ruled against me. I felt that the hearing officer did not like me and want to consult an attorney seeking to sue for Workers' Compensation benefits. An appeal is available within the agency, but I want to go directly to court because I feels that the agency appeal would be useless. Is that the right process??? any feedbacks?
I don't think you can just skip the WC system and sue them. Do you have a lawyer for this injury or did you go in without one? If you don't have a lawyer that would be the first think to do. Also some more info like your state would help. It would also help us if you would give some more details about your injury and why they claim it isn't a WC injury.

When will people learn that you do not go into court wc or any court without an attorney and expect to come out with a ruleing in your favor. unless you have been through the process of both sides befiore. and if a person has been on both sides of the fence they would know to get an attorney. Just my opinion I have 2 wc claims and i have been to wc courts before as the employer. Is there an old saying a man who defends himself has an idiot for a client. I think that is so true with wc cases.
