Full Version: what to do?

I fell at work about 3 1/2 years ago and never filed a claim. Because I felt it was my fault, and my employer kept saying workmen's comp doesn't pay for stupidity, so yes they know about the fall. But I've been seeing a chiropractor off and on since then and have almost constant neck pain. I have looked it up and in NH, where I live and work, the time limit to file a claim is 3 years. Is there anything that I can do now? I am only asking now because it has been this long and I still have neck pain and I feel that I probably will have this pain for the rest of my life. I still work at the same place, and love my job and my employers so I don't want to sue them, if I could even do that.

Chaulk it up as a learning experence, and when ever any injury takes place, fill out an injury report, get it signed, and get yourself a copy.

But, if you were injured again, make you claim this time, and state all that hurts right away.
Agreed, not a thing you can do about it.
yes, you can file a claim. while it is likely it will be denied you won't know until you try.
at that point you can decide whether you want to appeal the denial to the comp court.
and yes workers comp does pay for stupidity. employers/carriers are not allowed to argue who's fault the injury was.
workers comp is "no fault."
sounds like you have more concern for your employer then they do for you.
