so my lawyer called me today and said the ins comp called them about a settlement. now i have a permanant mod disability from a fusion of c5 c6 4 years ago. i just won my appeak and payments have begun again at a reduced rate, my lawyer said that its only gonna get harder from here on out and they are gonna stop at nothing to end this case.i dont know what to do they offered me alot of money but is it worth it? i dont want to lose my medical for the rest of my life if something happens again im only 31. any opinions?
I also have a fusion in the cervical it has been a couple of years....the disc above and the disc below are having problems...but I wont do another fusion what does your Doc say? have you had a disc o gram of the disc above and below? might wanna do that before settleing if you can
Blake, I wish my Insurance would step up like that. I have a hearing Monday on the 19th. and hope they do.

OK, moneys on the table, don't know how much? But, if the MSA has not been set up, I would think medical would be open then. Talk about the MSA with attorney, ask, if it hasn't been done, are they keeping medical open, and who will represent you, should you need legal help then...Cool

my lawyer said it will be atleast 100k nothing has been set up my lawyer got a call from the ins comp to see if i would be interested. this has been a long very hard faught case and will only get worse they want me done. now a week after i won my appelate appeal they are sending to the same ime for the 3rd time so they are gonna stop at nothing to end this. my lawter said my medical would be over if i took it. now from what i was told u never take the first offer
100k and medical would stop?? Unless you are suffering from a broken finger nail it doesn't sound like much of a deal to me. Sorry I don't know your story but that just doesn't sound right to me
I have not been there yet and at your age/future problems to me I would not take that.. Surgeries are not cheap and if you need another one there goes that money..........
Blake, just wanting to say, my first case & claim of the 3 level cervical fusion C3 to C7 has 100 K sitting on the table now for over 5 years. It will not change for me, as I also have my other 2 claims after returning work from that first fusion.

Caution yourself, for if brought to a hearing, Lump Sum can then be off the table, and the settlement could become less. You really need to get your attorney talking to you now, don't delay that...

A year or two ago, my friend settled his case of a fractured L5 and L5 S1 fusion, for only 85K, which was a major mistake, because they didn't pay him his TTD checks for 3 years. But, it was my friend that gave in, not his attorney.
it was my lawyer that came to me. it sounds to me they are gonna keep fishing imes until they get what they want to hear and take it to a hearing thats what scares me and i lose it all anyways. do i ask for more? what is the amount i should be getting for this type of injury? i know that the drs see no surgery in the near future but i am scared something may happen. i have health ins through my wife but is it worth the money? why after i win the appeal all the sudden 3 weeks later they want to settle? i dont know what to do about this very confused what direction to go
somethings to consider:

how is the atty fee figured?
does the atty get more money if you cashout your claim?

what if there are issues/problems in the future getting medical care from the carrier?
will your atty represent you? will you have to pay another fee?

your atty and you may not want the same result; your interests may be different.
different settlement options benefit you and your atty differently.
thats a good question i dont know.if i say yes to a settlement do i have a hearing for it? how long does it take to get your money? they have started my ttd again but its only 250 a week. the ins comp keeps bringing up the issue of my attachment to the labor market and they wont give up on that i know this. so i will have to look for work anyways. my lawyer also asked if i had applied for ssdi and i did and was denied, i didnt have a lawyer for it and he told me they can take care of that for me,so if i settle i can get ssdi right?
