Full Version: Can I request a settlement?

I was injured and received surgery on my back. In order to continue in my line of work I have to take pain killers on a regular bases (something I dont want to do). How do I request a settlement so I can finish school and start a diffrent career? How much can I expect and is there a way of settling for cash and still recieve medical care for my back? Any help will be appreciated.

you are not eligible for impairment benefits until recovery is complete.
I'm not sure what a settlement has to do with making that choice.
Workers comp rules don't prohibit such plans. go ahead and get into school it shouldn't change your benefits.
did you get a notice of closure?
you are entitled to medical when you need it. if you have permanent impairment your doctor needs to report it to the carrier.

Thanks, No I have not recieved a closure letter. What is going on is, I want to move closer to my kids in California. Although I have pain in my back still, it is manageable with tylenol and stretching, as long as I am not doing any extreanious activites (such as is my job). I want to settle to get some money for the move and to pay off some bills. But, I dont want to leave myself totally screwed. There is another vertabre that is bad but the surgeon opted to not fuse it when he did my surgery hoping that by the time it needed repair, WC will approve a disc replacement vs fusion. Do you know if I can request a settlement? If so, how do I get started? Again, I really appreciate your assistance, Thanks....

I should also add that I intend to go to school in California.
since you got a rating and did not ask for reconsideration you should be able to get a lump sum for the balance of your permanent disability benefits.
