So I call the EAO yesterday (employee assistance office) here in Florida. The Gentleman I emailed and spoke to over the phone told me that they were sending my benefits out ASAP.
So this morning I get online and check my email and see that my attorney has sent me an email.
He says the E/C's attorney got back to him late last night and they are putting my check in the mail today (Thursday) and to let him know when I get the check because he wants to make sure I have the correct amount. He sent me this email at 9pm last night. I knew at about 4pm yesterday that they were going to send my check out because the gentleman at the EAO told me. He even told me that he would call me with an amount.
He said they also want to set up a settlement confrence. But no figures were discussed.
Since I didn't hear from him yesterday (at closing)I was going to give my attorney "walking papers" Typed it up and put it in an envelope and everything.
Do you think it would be wise to keep him? Being that it is almost the "end"
Yawhoooo.......congrats!!! Sometimes you really have to do things yourself to get things done. Be persistant!!!!! Be your own lawyer sometimes even though you have legal help on your side. You need to sometimes do your own homework even though you have a lawyer on your side. Keep ALL your MEDICAL records...etc.
I would say that if the lawyer called you yesterday and was in contact with this Insurance co. lawyer ( I think that is what you mean by EC.) Cause it should be IC..lol then I would keep him. You are going to need legal help when it comes to determining your settlement and if you are almost at the end keep him. They love to fight when it comes to settlement time. It would be hard I think to get a new one involved right away at this end point. I think the lawyer you have now knows your case very well and knows that you are getting things going even if he is not. Give him/her one more chance seeing for now.
So GREAT JOB and continue with the good work. Sometimes we have to be confident and strong and you have shown you can go gettum girl..LOL Congrats again and let us know when the check arrives : )
I think sometimes we forget we are not the only person our lawyer works for...I explained up front to my lawyer I needed to check base with him often as I want to know how my case is progressing..My lawyer was good about him,his paralegal or secretary calling me and updating me....Not all lawyers are this way or maybe they are if you tell them you need this......good luck
When I say E/C I mean employer/carrier that's how my attorney refers to them.
Also I know my attorney has many more clients, but it doesn't take but a few minutes to let someone know what's going on. Any time a lawyer thinks you will replace him is when he gets back to you right away.
Sad but true.
Great News Cookie!! My Opinion Only, but if Your Attorney took the Time at 9:00p.m. to E-Mail You, it Sounds as even though They are Busy, They did get Back to You, and Long After Business Hours! My Attorney and I have been Together about 4 Years now, and in that Time He Became Partner, and I Asked Him Once how Many Clients He was Managing on His Own. He told Me that He has a Total of about 300 Clients He Represents, but Many of those are Settled Cases He Just Monitors. Once a Case Settles with His Firm, if You have any Future Problems, they will Represent You Free of Charge for Life on Your Case, and They would Only Charge if They Fight and Win Penalty Monies, then He would Receive 20% of the Monies Won. but if it's over Medical Issues, or any Other Matter that Doesn't Involve Receiving Monies, there is No Charge! I Hope Your Check Arrives Soon, and it's the Correct Amount!!
Was wondering something. A woman called me from the EAO and told me they sent me out 35 checks today for my impairment income benefits. Do they send all the checks at once and why so many? Are they sending me 35 of them so they have a reciept for all the weeks I am owed? Cause they owe me 35 weeks of IIB but I didn't know they would send me all at once????? I asked the lady 3 times how many weeks and she said 35
They do send everything owed at once. This may be 35 weeks all in one check. The dates that it covers will be on the stub. As for attorney's , I told mine upfront that I would always expect a call back in 3-4 days unless I leave an urgent message and that means by the end of the day or at least within 24 hours. He always honored it. I have gotten phone calls during his break from court, etc.
The lady that called this morning said they were going to send 35 checks they only owe me for 8 weeks. The 35 weeks is from my impairment rating. It would be better to only send me one check.
Doesn't matter if 1 check or a hunderd checks, take them, and be just as happy either way.

I was just trying to make sense out of 35 checks when it would be easier to put it all on one and heck yeah I am happy and I will run to the bank with them before they change their minds.
