I know this has probably been covered, my apologies....now that the Dr has said I am P&S, who am I waiting on to determine my dis. rating? Does the Ins. Co. send somewhere or do they come up with the rating and mail to me? I hate all this "hurry up & wait". Thanks for listening.

your doctor can give an impairment rating.
then the rating is sent to the state to do a disability rating
if eveyone is in agreement the carrier has you sign paperwork and the comp court approves.
if there is a dispute it takes longer.

My Dr did the rating but of course the wc aduster is questioning it and wanted all my medical records even those that had nothing to do with my broken hip. I did tell him I didn't thing he needed all that and will just give him permission to get record regarding knee surgery that I have had( he questions my limping).

nona, Before the impairment rating is finalized, there are several factors to be considered such as your age, prior injuries, and any pre-existing conditions. In order to get the facts, the I/C has to review all your medical records. I'm in California and had to allow my I/C access to all my medical records for the past 7 years for my orthopaedic injury, and all my medical records since I was born, for my consequencial psychiatric injury. There is no HIIPA in WC.

You will eventually be sent to an IME for a new rating, and then the DEU (Disability Evaluation Unit) will make the final determnation.

Educate yourself on California WC laws. That's your best defense.

if either party objects to the treating doctors impairment rating then the parties are to resolve the issue thru use of a Qualified Medical Examiner.

The Insurance. Co. & myself agree with the Doctor. All the ins. rep. told me was to wait, and that sometimes it's nice to get "a little surprise in the mail".

if there is no dispute they'll draw up the paperwork to get it approved by the judge.
your PD advances will continue and any medical as well.

No worries 1171...I really appreciate your advice. Unfortunately, I have not yet received any PD payments. It would be nice if it started soon....
