hello everyone its been awhile, i need a little help, april 6 i was placed at mmi by the dr. who performed a bi-level fusion (l4-si) june19 i was givin a ime exam which ruled in my favor. the ime dr. stated that i have 2 fractures in my spine as a result of the surgeon implanting the titanium screws. he also stated that they need to remove the hardware and repair the fractures and reinstall the hardware and then do some procedure to relieve the pressure off of my l5 nerve root because theres some severe encroachment on that nerve root. having said all that i have 2 questions. do the ic have to pay me retro and 2 do they have to give me the medical treatment outlined in the ime report. by the way i live in indiana. i do have an attorney who says they can not deviate from the ime recommendations. i am very leary of these guys they have sent me to see a dr thats 2.5 hrs away and i think they have something up thier sleeves to try to get around paying for this next surgery. i fell 14ft. off the top of a semi-trailer back in 12-07 i have already incurred over 300k in medical bills. any help would be greatly appreciated. thanx
I don't think you have a thing to worry about. If the first surgery caused the complications then comp is on the hook for those and any others that follow as well. Sounds like you should have the IME doc do the surgery though.......

Apostolic1, what does your doctor state about the IME report?
The IME, is the Insurance Carriers Doctor, and then again, does the Insurance accept the IME medical Opinion?
Why hadn't your doctor told you this?
Sounds like the sent you to INDY, or you may of had your surgery in Indy?

hey whats up bb im not sure what question you're asking. i know the ime dr is paid by the ic but my atty said every thing has been ruled in my favor. the dr that did the surgery placed me at mmi 1yr after the surgery the only way we found about the fractures was by the ime dr and yes the ic has accepted the ime report they have started my ttd payments and has paid me all the back pay that was due me
Actually BBB , I do know Indiana well but I have never suffered a work injury in that state....yet. I'm not aware of any state that does not recognize flow through conditions and my surgeon comment was really saying find another one.
I do agree Cycler, I also would as the injured worker want to know why the treating doctor/surgeon did not tell this person of such Fractures, as it is their sole duty to inform their patient.
Then some doctors/surgeon wonder why Mal-Practice Insurance is going up.
I too would change surgeons, I too would consider asking to have the IME surgeon take up my medical care, as they shown they do care. Care more then the treating doctor / surgeon as I see here.
As is very good here, as the Insurance didn't have to follow through with the IME, and could have followed through with the Treating Doctor/surgeon instead. I'm glad they took the opinion of this IME. That is great.
