It has been six weeks since the insurance company stopped my TTD benefits. Because I reached MMI. They should have started my IIB but have not. Also mileage was sent to the insurance company on the 6th of July (give it 3 days to get there)and I have not gotten anything back from them as of yet. Also....When I went to the pharmacy to get my medicine they denied it. So I called my attorney to let him know of this and that was a week ago. No one is calling me back. I did get my meds cause the attorneys office gave me a name of a pharmacy that will give you your meds regardless if they are denied or not.
I figured I would have found out something by now. My attorney did say they (the insurance companies attorneys) were talking about a settlement ( no figures yet) but they wanted a future medical expense list from both my doctors. I sent both my doctors the form by fax a week ago. Have gotten one back so far. Even if they want to settle, shouldn't they still pay me my IIB?
Yes you should get IIBs once your impairment rating has been fixed.
I don't understand why after telling my attorney I haven't gotten these benefits he hasn't at least said, let me see what's going on and get back with you. In stead he mentions they want to settle but mean time could use the benefits they owe me. And even if they wanted to settle why wouldn't they give me my benefits? And why are they denying medication?
because they can.....when they settle your back pay will be part of it.....but the longer they keep you without money the quicker(in their mind) you will settle and for less
Jayne is right it's just because they can. And they are hoping if they can keep you without money you will settle for less. If they are paying you every week you don't worry as much about how your going to pay your bills. When you get behind they hope you will take any amount just so you can pay the bills.
Hate to say it but Jayne and Manley are probably right. There are adjusters (not all!) that do what they call "starving you out". It's a despicable practice and many times they get fined heavily but some still do it.

Also, attorneys don't get a fee if they don't win you benefits so if the IC was paying you on time, your attorney wouldn't get a fee on those benefits so sometimes they are not in a huge hurry to push it.
I thought they were doing that. I am glad I am in a situation where I am not "dying" for the money. It is good to have it but the longer they wait and I don't settle, the more interest and penalties they will have to pay me.
