Full Version: Is This a Glimmer of Hope or I am in for a huge Let Down

My work comp case in California was denied. The denial letter was sent out after the 90 days although the date of the letter was prior to the deadline. It was also sent out a day after the deposition in August. I have not received any TTD wage reimbursement since my injury in May. My lawyer protested at the deposition to get some TTD benefits. The other lawyer denied. Yet today my lawyer called stating they got the other side to agree to TTD benefits temporarily pending an AME appointment. The court hearing has had trouble being arranged due to my case does not have a number and the judge will not hear it without a number. My question after this long rambling is this? Since suddenly the Insurance defense attorney has agreed to paying TTD benefits which of course do not go back to May when the injury occurred but will at least start supposedly in a couple of weeks, does that mean that the Insurance company thinks that I have a pretty good case of winning my appeal and they are now playing nice?

Can you clarify your statement? Do you mean that the Insurance company's hand has been forced until a final ruling? I just don't want to get too excited and I definitely will not hold my breath for the temporary payments until I receive that first check.

clarify??????????......they must think you have a good case or they wouldnt agree to pay you TTD....
Sounds like they are about to accept the claim to me. Smile
You wrote they will agree pending a AME appointment. That is the part that gets me. They will send you to a AME appointment for the IC to have you looked at and give their opinion. That is what scares me from experience of all of my IME's , AME's etc. Everyone of them came back cutting me down and lieing about my case, mentioning doctors I never saw etc. They are very good at finding doctors that will do injustice to the patient for their own benefit of $$$$$........ Just be careful when you go. Also there is other people on here that have NOT had bad experiences such as mine. But I have not had ONE doctor I seen from the IC side that has taken sides with me. If that was the case they would no longer be on the IC's list of doctors to lie for them to get out of paying benefits.

I hope that my lawyer would not agree to a physician that would not be a neutral party or at least as neutral as possible.

that was very interesting Lilly. Also it is sad to think that this is an acceptable practice, this work comp system
