Back in 2004 myself and another employee were lifting a heavy (200)lbs plate when I felt a burst feeling in my lower back. My co-worker could tell I was hurt. And said when your knees buckled I knew right away you were hurt. The next morning I came in and the owner was sitting there and could tell I was hurt. I told him what happened and that was it. Now I can barley stand and have been seeing a doctor for 18months now. Therapy, epidurals now. I got an Att about a year ago. Now Im on light duty from my doctor. My employer keeps me on the same job even giving me some jobs that exceed 100 lbs. My limit is 30. Im limping and need to sit most of the day. when I get home all I do is lay down all night. What do I do? Do I have a case?
Has this been covered under WC? If you are not following the restrictions you could be in trouble. If your employer is asking you to do more then your restriction reminde them of what your restrictions are because if you have been going over them this does not look good on you at all. Not sure what you are asking if you have a case or not.

I can tell you WC is a tough road financially.
I think your best option is the advice of your Attorney.
4 years is beyond the statute of limitations in most states, but your atty would know for your state.
I'm not sure what this site can offer that your atty can't.
I live in Michigan. I have given my DR. slips to my employer, but he told me his Insurance agent told him to hang on to them and not turn them in or they would send me home. I told him "My weight restriction is 30 lbs". And he gave me a 100 lbs job. I said how am I supposed to do it? And he said "Slide it around".
I have a Lawyer. I just havnt been able to get ahold of him last week. Does that look bad for my employer?
looks bad for you if you dont follow your Drs orders.....well hell.....Maybe its time your Doc took you off work if your boss cant follow your Docs restriction orders ..is it a fairly large company? do you have someone above your boss you can speak to such as your HR person...if not I suggest you have a sit down with your lawyer.
Something is fishy with the hold onto all paperwork stuff. You were given restrictions and your employer should have been given the restrictions also. Now that you have gone beyond them it could cause problems because you are now doing 100 lbs instead of what your suppose to do. You are showing them you can do that. Not good. I would let someone know right away that your limit is 30 lbs and if they can not go by that restriction you should be taken out of work RIGHT AWAY before you cause more injury. They are pushing the limit of your restrictions and you are just showing them you can do more.
PS. All paperwork SHOULD be turned into the insurance co. as your appointments go along. You should also be giving your employer a pink slip or white ( whatever you get from the doctors) and keep them informed at all times of your condition,changes, restrictions etc.
