Full Version: anyone get injured on job that holds a CDL?

Sorry for asking so many questions but does anyone know about CDL rules? I have 60 Percent loss in right leg.
My DOT card will expire 1-10. I am scared I will not be able to renew it. I copied and pasted rules below.

(b)(1) Has no loss of a foot, a leg, a hand, or an arm, or has been granted a skill performance evaluation certificate pursuant to ยง391.49;

(b)(2) Has no impairment of:

(b)(2)(i) A hand or finger which interferes with prehension or power grasping; or

(b)(2)(ii) An arm, foot, or leg which interferes with the ability to perform normal tasks associated with operating a commercial motor vehicle; or any other significant limb defect or limitation which interferes with the ability to perform normal tasks associated with operating a commercial motor vehicle
it really depends on what the loss is. The DOT medical examiner will be the final say on the matter but it sounds like you will lose your CDL eligibility from your post.
Got a CDL but don't drive right now anyway. But one I can think of if your driving now and you know this could be a problem I would say be careful. I just don't remember the rules but if something changes could you be in trouble if you didn't report it? I don't know the answer I'm just saying CYA.
I have Renewed My CDL in Pa. twice since being Injured, as long as the State gets the Fee, it will Still Appear and be Valid on Your Driver License. Now for Me to Drive, I would need My Updated Physical Card, which of Course I wouldn't Pass. I just Keep them in Case the Sky Opens Up, and a Treatment that would Cure Me Falls from the Sky!!Smile
Hello. In Louisiana. Have not operated an commercial vehicule since 1-08. Expiration of CDL-A in 7-10. Personally, I do not feel that I wil pas the examination (medical). I will not concieved the though of jepodizing the safety of others while operating an up to 80,000lbs. vehicule. Try driving straight and -in control- with some type of impairment. From my understanding, vehicule homocide in an commercial vehicule, failure to maintain. Will put you to the curve, deep. Sorry for the wording. That's how I feel. Izell
You better hurry then because there will soon be a national data bank of exams and the Dr must pass a national test to do a CDL medical exam.

Of course that's not even beginning to address the fact that you admit that you would be putting yourself and the public at risk since you state you have 60 % loss of use of your leg.

Only thing I think I can do is find a doctor that I can get interested in chatting and not paying attentain to the guide line of the DOT physical form. That is what I did last time. Oh, I hate this stress!

I would hate to try and get away with something on a DOT exam. Seems like the one place you would want to tell them everything, plus make sure the doctor notes it. Even if he says no problem I would want it on the report so if something did happen down the road that would put it back on the doc's shoulders. Remember when you are driving you are not only put your life on the line it's everybody on the road around you
I don't have a problem driving. I took a test for 8 hours before he would let me go plus two more driving test through my work. I have had no problems driving and I have been back since march. I wouldn't go back if I felt I would hurt someone. I always put others first my whole life.
If this is true why are you worried about the physical test? If you have any doubt about it I would make sure the check it in the exam. As I said before I would want to make sure they knew everything and noted that you told them. Not sure what you drive but imagine you get in a wreck, somebody gets hurt, they are going to pick your driving apart. Even if your leg wasn't part of the problem they are going to blame it on that. If the doctor has everything in a report that will only help you and if the injuried parts lawyer digs up your post saying you were worried and hope they didn't catch the loss in your leg look out.
I understand what you are saying Manley. I spoke to a lawyer today. She told me that the IME I am going to next week can say I shouldn't be driving even though I have been fine driving. The IME will have all my reports including my EMG, MRI, surgery reports, etc... Plus I am bring in my current xrays. If the doctor states that I shouldn't be then I will go back to school and collect long term disability and SS Disability. I do know one thing, I will not be able to do my job for the rest of my life, that is why I am trying to get into supervision but with the county's budget, it looks like it is going to be a while now. I have been always straight forward with my work even though I don't have to say anything to them. I let my doc, nurse case manager, l&I manager know everything but I don't bitch to much. And for my doctor that will do my dot test, he receives copies of everything that is going on with me from my surgeon. I do have good push down strength. I just can't lift my foot or bend it in. My leg is getting smaller then the other one which sucks. I wear an AFO We are talking about doing a tendon transfer but he wants to wait until my 1 year mark from my fusion in my back. That is in Nov. To let everyone know, I am coming to grips that I might really need to look into doing something else and retiring from my field of work. I am in my thirties now. I have a long ways to go still. I just hope this will be over soon. I have been dealing with this for 2 years now. I know some people has been dealing with things longer. I just want my life back and if that means changes with my job then fine because now I know I will be ok since I spoke to a lawyer today. She confirmed what everyone including the L&I has been telling me.
