I have heard here, as well as elsewhere, that if God brings you to it, he will bring you through it. I now believe even more than ever that is a very true saying.
Y'all know what I went through on my last WC claim..denied the whole time till I was declared MMI and then a very small impairment rating. During the time that I was fighting the claim, I reeceived under $1000 a month through LTD till last month when they suspended it because I was receiving my IIBS, which is not supposed to be used as an offset on LTD, as it isn't wage replacement. I have been under review on that since the 21st. Still waiting.
However, my LTD company offered to refer me to a law firm so that I could file for SSDI. I accepted as any fees to be paid to the attorney would come from back pay that SSDI would pay to LTD if I was accepted. My claim was received on 16June09. Until a week ago when I called, it was said to be in the medical determination unit. I called SSDI last week and they had sent it out for medical review (our government redundancy at work). I was told that it would be up to 90 days before anything was sent back to SSDI.
Well today, I went into my savings account online.. and wa quite shocked when I saw I had a balance over $2000. I knew there was no way in heck that I had that amount in there. So I opened up the history... direct deposit from SSDI. Although no letter as of yet, and all it says on the Social Security website is that a determination had been made and will be sent via USPS. So it is now official. I am determined permanently disabled. I don't even know what date they used t determine my disability. And now that I have been approved, I have to get SSDI for my son under my name.
Even though it kills me to know that I will never work again.. one good thing will come of this. I will now be eligible for medicaid. No ifs ands or buts (once I get the letter from SSDI) This means that once again, I can start going to my PM and get back onto something to help the pain, insomnia, depression... as well as finally getting to see the neuosurgeon about the herniated disc at T8-T9.
I now need to find out if SSDI has done an offset on my LTD and if so for how much. Because I am no longer receiving it, they will no longer have to pay. Or, if LTD accepts the backpay offset, they must restart my LTD and pay me for last month as well. And then, they can't claim an offset against my IIBS as well and try to force me to pay back the $2900 they claim I owe them. It's one big mess, but at least now I know I have an income again.. instead of wondering what I would use to pay my bills at the end of the month with no income.
I don't know how much the attorney actually earned, but if it made it possible to get my SSDI sooner and not have to go through an appeal process... he sure earned every dime that he gets paid.
