I spoke witht my wc attorney today and he is requesting another hearing.

The last hearing was in April, we are requesting additional treatment for the right knee and seeking to add the back to the claim and carpal tunnel.

In Kansas the judge has 5 days to make a decision from the date of the hearing. In my case no decision has been made, earlier this summer the ALJ went on medical leave for a total knee replacement and another judge was to be sent from Topeka to replace the ALJ, to date this hasn't happened.

According to the attorney the best way to approach this is to file for another hearing, and he is doing so today.

I have the same attorney for the auto accident and he tells me a demand letter has been sent to the other driver's insurance company.

I am to send my attorney the list I am making of things I can no longer do because of the neck injury.

And my attorney is working on a settlement amount.

Yea the forum is back!!!

I received communication from Medicare in the mail, they are wanting to know the date of the accident and other misc information and have contacted my attorney.

The accident was 12/07 and Medicare started 9/08 by the time I started receiveng medicare I had been placed at MMI.

Only one doctor visit and one x-ray have been paid my Medicare.

My doctor tells me I will need neck surgery in the future. Perhaps future treatment is the information Medicare is after, anyone know?
Bummer, good luck with everything.

Medicare may want the info so that when the settlement on the accident is done, they get reimbursed for anything that they have payed out.

They may also want the settlement(W/C or Auto) to include a medicare offset. What did you lawyer tell you?? Did they give him a valid reason?

I received the letter Friday afternoon and haven't visited with my attorney yet.

Never been to an OS on the neck injury just my doctor, osteopath.

He has been on target with the OS on the knees and back.
yes, Medicare will need to cover their butts. This is a lengthy process re: set aside. EVERYTHING Medicare does is lengthy!

The attorney called this afternoon on the auto accident.

He has all the figures together and gave the amount we are requesting in the demand letter for settlement.

Must say it is a higher amount then I expected. I do have an unpaid medical bill I will need to take care, hospital placed a lein on the settlement to make sure they get paid.

The insurance company we are dealing with is one of the more difficult one.

The adjuster called me the day after the accident while I was in the doctor's office requesting to settlle.

Guess he thought my name was stupid!
