Full Version: released to full duty but no job available

Hello from maryland
I was injured a little over a year ago and was released on light duty right away but my job claimed they did not have light work but finally released me light to medium duty which IC claims its full duty and my job decided to take me back 3 months later after the release of full duty . the IC cut me off from benefits and tried to find a temp job and was not able to land . How legal is this? Is so is there any help anywhere? I am in disbelief!! I did everthing by the book I worked in this company for 13 years with perfect record is this how injured people live. (my injury is tail bone, back and 1 leg I went to in network with IC doctors) Any help will greatly appreciated

if not, are you receiving work comp disability benefits?
1171 The job they have for me will start in a month and no I am not recieving anything
if your employment was covered by FMLA you should have job protection for upto 12 weeks while you were off

if you weren't given that protection you can file a complaint.

if you are released to full duty and will start work in month you may be eligible for unemployment.
Thank you I do have job protection but my big concern is the fact that I am not getting paid nor given a position and if there is any law workman or labor law that protects me temporarily. I hope you understand my frustration not being able to have no income at all for three months
I would think if you were released to return to work and your employer has a position for you in a month, that would be the same as a lay-off and you would be able to collect unemployment on a call back statue. I agree with 1171. Call your unemployment office or go talk to them.
How long has it been since you were told you could go back to work full duty,?.
Tuffy it has been 2 months.
even if they can't take you back at all workers compensation benefits are only paid to those on disability.
outside of FMLA job protection rules, Employers are not required by workers comp law to hold a job or create one.

other then unemployment I would recommend you contact your union. they can help find work or have emergency benefits for their members. your local welfare and social service agency can help with short term medical housing and food needs.
wow thank you for your responses if this is the only help that is out there it is so scary "dont get injured or you're..." I am speechless
many who are not injured have lost or will lose their jobs in the coming months. this is not a good time economically.
many states are trying to implement early return to work programs and light/modified placement situations to reduce the financial impact on the hard hit injured worker but it's an uphill battle to get either the employer or the employee interested.
