Full Version: Can an employer force me into a workers compensation claim?

Louisiana Employer

Im on no lifty duty, but I can still perform much of my job duties. I am a heavy equipement delivery driver.
I can still make deliveries however I am retricted to heavy lifting due to
hearniated disc.
I cannot afford to go on limited income. My employer wants to force me to make a compensaton claim?
What should I do?
Is your employer the one restricting your work? Are you getting medical treatment for this? And if this was hurt at work why would you not want to get this taken care of? I can understand not wanting to lose income but trust me you want to take care of your health. If you don't get the proper treatment for you problem it could get worse. And you could wind up restricted for life, and trust me when you put money over health you will lose. You don't want to have to live with pain the rest of your life.
the employer can file the claim with their comp carrier whether you want it done or not but you are under no obligation to accept the benefits.
the benefits are voluntary; filing a claim is not.
