My company provide us with both coverages. So far my claim is still "pending" awaiting my MD sending info.
Does this pay along with wage loss payments to = 100% of lost wages or does it pay when no other income is available?
My Dr. keeps saying I won't be able to work as an RN again so I am concerned if I'll have an income while I am am looking for a job where I don't do bedside care (IF I can't go back to my current job). My FMLA was approved, it started 6/26/2009.

Hi rosie toes... long term insurance is different per policy depending on what your organization has bought. It also depends on the company in terms of what was even offered as a contract to your organization. Typical payments would be a percentage of what your salary or income was minus overtime (unless stated differently in your contract) etc. The best way to get this information is to get a copy of your policy from your HR person. They can give you all this information. I understand your delimina. I too am a RN who has Multiple Sclerosis. I worked in administration ... but eventually that too was more than I could do..therefore, I am now retired. Good luck to you. Red

Welcome to the forum. Red gave you some very accurate info and good advice. You need to get your company's handbook on their disability policy to see exactly what type of plan your employer has purchased. When I first started collecting STD and then went into LTD the percentage they paid was 60% of my wages. After I began to collect WC they then started to take an offset from my WC wages. Since this was a policy I had while employed and I paid a portion of the premium they had to continue to pay me but at a minium amount while I cannot work until age 65. The age they will pay you up to can vary also depending on what your company plan has laid out for the employees. I am totally disabled and they are not paying me much but this will continue until I am 65 then it will stop. I hope your employer bought a good policy for it's employee's. This is what it will all depend on. Now, I settled my wages part of WC but left medical open. When I did that, because I was not getting a WC check any longer my disability was suppose to go up from the minium back up to the percentage but it sure did not work that way. They are continuing to take the offset from my wage settlement is why it did not go back up and I am stuck with this small minium payment. As they have stated to you it rally depends on the policy plan that you are under. I am in the same situation as you, I am off work and have now applied for my LTD Insurance policy. I filed got the Dr to fill out his part, the other day I got a rejection letter from the LTD ins co. Saying that since my disability is a wc injury that it was not covered in the plan that i have. But if wc denied me my wage benefits to send them a rejection letter from wc and then the policy would cover me. I went to my employers benefits wed site and found a 50 page summary of plan description for the LTD ins. I went through
all 50 pages, no where in the 50 pages does it say that that a industrial injury is not covered. What I did find and print on page 8 it states the coverage under a plan does not replace or affect the requirements for coverage by workers compensation or state disability insurance. On pg 14 of the summary it shows what are deductible sources of income (they would use to adjust the amount of off set that they would pay). it says they will deduct fro myour gross disability payment the following deductible sources of income.
1. The amount of that u receive or are entitled to receive as loss of time benefits under:
A. a workers compensation law
B. an occupational disease law or
C. any other act or law with similar intent
On pg 17 of the summary is states if subtraction deductible sources of income results in a zero benefut. then there would be a minimum monthly payment amount. (is shows that minimum monthly amount)
Tomorrow I am calling the LTD ins Co and going to explain to them what i have found in the 50 pg summary of plan description. I feel the denial letter they sent me the other day, that they are incorrect in what they stated in the letter compared with the 50 pg summary of benefits dated January 2009. Yes it will only be a small minimum but I am entitled to it as i pd for this policy every pay period.
I would suggest you somehow get your hands on a summary of what plan you have been paying for and go through it page by page and see what benefits you are entitled to..They are an Ins co and they will screw you if they can if you let them.

I worked for a large Medical Org, (Hospital) My WC claim was denied for a year. so no benifits from them. My short term kicked in as I was placed on FMLA and LOA, when at the end of my FMLA (12 weeks ) I was terminated, Then my Short term ended, because I was no longer an employee. But I was able to collect unemployment, as my Dr had released me with restrictions to go back to work.
When my claim was accepted and settled, WC had to pay back the ins co. I received 75% of my wages on STD, actually more than WC would have paid here in Illinois.
So here is what I received
75% of STD for 12 weeks(FMLA )
unemployment for 24 weeks because I was terminated.
Then I lived on my SS Retirement and my savings untill I settled, I was already collecting my SS retirement when injured( at age 65) So I retired after my settlement.
So I would think you can collect STD for at least 12 weeks or untill your claim is accepted and WC kicks in. You can check with your ins , or your HR dept, they would know. Unless you have an attorney then you should go through him/her. Good Luck
Wow! I was under the impression from my policy, they pay even if an employee is terminated because of the disability as long as the employee pays the monthly premiums (which I don't think are too bad for st/lt coverages.
I got a call today saying my claim was denied because my Dr has failed despite multiple attempts, to supply the info needed to the company. The insurance people did say as soon as the Dr complies they will reopen my case asap.
I am currently being paid by wc, I am concerned about later....if I can't go back to my current job.

I think it is time for you to consult with a good WC Attorney to protect yourself. sounds like you are going to be in this for the long haul.
wc is payingme...st disability was denied based on the MD not supplying info.
I didn't expect both at once I just want the st disability in place when the comp stops.
My fmla runs out mid sept and I am not sure what kind of restrictions I will have. If they don'e change I am sure I will lose my $70,000 a year job.

Rosie, Sorry to say, but you may loose your job anyway, when your FMLA is up. They then have the option of terminating you, But you could still have WC if you are not released to work by then. If you are terminated, you may not have the STD or LTD option. but if the Dr releases you and you are terminated, you can apply for Unemployment, but then your WC stops. Kind of a catch 22....Welcome to the wonderfull world of WC=NOT.
