my husband was injured at his work in oct 2008,large barrel fell on him,injuring his back..he started recieving workmans comp pretty quickly..however his employer fired him 23 days after the accident,citing the business was going under...we recieved workmans comp until may 2009,had an ime and they decided he was well enough to go back to work...we have an attorney,he sent us to his dr and they said he is not ready at all to go back to work,saying he has nerve damage..my question is if they get his workmans comp started back up will he get backpay from may till now? we live in ky..this is my first post...i have many questions..ill start with this one..thank you so much..
temporary disability payments can be retroactive if the judge agrees that he has not reached maximum medical improvement.
