i am in n.c. and was hurt by falling off the back of loading truck onto my right wrist(i am right handed).this happened about 9 months ago.i went to w/c dr and had mri athrogram done to wrist/hand.it shows i have 3 torn liagaments and i am out light duty no more than lifting 1-2lbs.i was told to get a second opion from the first w/c doctor after he stated that he will not do any surgery on wrist.my question is i told my lawyer to just settle the case. monday i have a appt with my lawyer and the insurance company filed a form 33.i do not have a mmi and i really just want to settle this case.MY QUESTION IS CAN ANYONE TELL WHAT IS A FORM 33 FOR?WHAT TO EXPECT FROM A HEARING WITH THE INSURANCE COMPANY LAWYERS?AND NOT HAVING A MMI CAN I STILL SETTLE MY CASE WITHOUT A MMI AND STILL HAVE A REASONABLE SETTLEMENT?. THANK YOU
ok I do not believe you should settle till you are MMI ......what do you consider reasonable? do you have a ballpark figure?

NO I DO NOT HAVE A FIGURE,BUT I AM OPEN-MINDED RIGHT NOW THANK YOU FOR RESPONSE
well understand it wont be much...depending on what your rating is......could be nothing to several thousand dollars not as much as you would have made in the same time period if you were able to work....
thank you for your time and from my understanding i dont have a rating.with the doctor reports i have and the injury would that make a diffrence in settling my case?thank you
depends, you must have a rating to get a disabilty award....to get the rating you must be at MMI...a claim form 33 is a request for a hearing.....if you have no disabilty rating there is no award......go to the top of this page click on state info and then on NC all your info is there
A form 33 is a request that a claim have a hearing.
First off, there will be no "settlement" with out an impairment.
Second, why would the IC want to settle without a rating????? HHHMMMM?????
The only reason I can see that they would is because they want to save money.
Lets say if your injury might gat a 10% rating when all is said and done. The IC knows this. With what you are doing, they would only offer the amount for a 3% rating. Think about it. What do they have to loose????? HHHMMMM???? Nothing.
I know you have an attorney. I hope is a good one and is not only looking for money. If you think about it. the way you are going about this. The attorney can settle your claim and get his/her money with minimal work and the IC can do the same with a much lower pay out.
Good Luck and Take Care
If you settle....who's going to pay for any medical down the road if you develop other problems related to that wrist injury? Your regular health insurance will not.... as it was orig a WC injury. The IC will get out of it as cheaply as they can....this is why you must fight for what you deserve. I also agree the lawyer may be trying to make a fast few bucks off of you. Beware
