[font=Times New Roman][font=Tahoma]ok...I live in Minnesota. At the end of June I strained my lower back while waitressing. We to the e r that night and they wrote me out of work for 2 days-said to go see my regular doc.
I saw my regular doc and he wrote me out for 7 days and said: you need to come see me if you need more time and then he had me start physical therapy.
Had 1 appt so far in therapy and my back was actually feeling pretty good.
Brought in all neccassary info to work and repeatedly asked my manager if they needed anything else from me. I was told no.
At the end of 7 days went back to work and everything was fine until last night-I was carrying a bus tub and messed up my back. Again....
I was informed last night from a different manager that I was suppose to have been released back to work from my doctor-NO ONE TOLD ME THIS!!!!! Does this screw up any workers comp???? Since I hurt myself last night is is considered a new workers comp issue or the same?
I was not pulled off the floor-I was asked a few different times how I was-I said ok but I was moving very slow and not carrying anything. I stayed on the floor because it was busy and I didn't want to look like a wuss (I guesss). I've since been told I should have been taken off the floor right away. Especially since it is a "re-injury".
I did not go to the e r this time-I'm going to see my doctor tomorrow.
What are the "rules" or "laws" that may apply here?
Was it my responsibility or theirs to inform me about a note from my doc releasing me to work?
Is the re-injury a new workers comp claim or on the same one?
By-the-way:NO INCIDENT REPORT WAS FILLED OUT LAST NIGHT.
I know NOTHING about how any of this works.
I would appreciate ANY kind of guidence/suggestions anyone may have.
I have been given no forms or any kind of documentation from my employer either.
The rest. I work for is small but has 4 rest. total(I don't know if that matters).

whether you had to be released or not is irrelevant. they took you back.
yes it appears to be a new injury. file for a second injury. it may be just a temporary condition but until you know for sure you need to file a claim.
put down the events in writing and file a claim for a new injury.
