Hi everyone. Has anyone ever received workers comp TTD payments and LTD payments at the same time? Can you receive both at the same time? Someone told me you can receive both but the payment can not equal more than 80% of your pay. Can anyone confirm this for me. I am from IL. Thanks

Thank you for your response. I did notice a previous post from a Little nurse, she asked a similiar question concerning WC and Social Security Disability. I am hoping someone may have had this experience and can offer clarification.

You can collect both, but your LTD company must be notified. They will take an offset on your WC monies, so that you aren't receiving more than 80% of your pay. Or so I was told by my LTD company.

However, when talking to a friend who is a WC adjustor for an IC out of Oklahoma (she has worked in several states) I was told that the LTD could not touch my IIB's (here in TX that is what you get once you have been found to be MMI and recieve an IR ..impairment rating).

I as of yet, have not contacted my LTD, as I wanted at least one more monthly check before they start pulling money from them to pay back what they have already paid me. And I want to talk to my attorney first as well. I don't believe that they can touch these funds or hold them against me, as they aren't payment's for being out of work but, instead, are my monies for the loss of use of my arm.

If I were you, I would contact the LTD company and see what their policy is.

Ok, thanks. I started receivings LTD in March. LTD company only seems to be concerned about Social Security Disability being approved. The initial paperwork did note that I had to report any additional income to LTD and that I was responsible for repaying any overage.

so when is the start of LTD Do you have to be off work for a certain period of time or is there a rating you have to have with your medical disability?

I have not been given a rating yet. My job placed me on a medical LOA and then fired me when my fmla was exhausted. So yes I was off work for a pretty long time before the LTD was approved.

You would need to check with your employer and see what their policy is. I had to be on short term disability for 6 months and then my long term kicked in and I am covered until I reach the age of 62. Still a good length away. Some companies do not offer short term prior to long term. Most long term policies require that you be out of work for at least six months, and that you be out of work for another year or longer before they will even consider you for LTD.

As I said, check with your human resources and see what their policy will cover. Most of the time, LTD will only pay around 60% of your pay. If you are receiving TTD, then they will deduct that amount from what they are paying you.
