Well my long term insurance called and offered to buy me out yesterday and they are dropping my ssdi claim so now I have to start all over again.They also had a pi watching me and they claim they seen me doing things around the house and I was like well the yard and cleaning wont get done on its own and if they do have this info why are they offering to pay me to go away,seems like they would say good buy and not pay me a dime.well its been a trying time the last couple of months with pain levels high and dealing with trying to get all this behind me.the court still has not approved my deal to settle the wc and i find it funny it was a month and a day after signing the agreement to settle wc that the long term people call and say well we want to buy you out and be done with you.It all seems funny and the wife and I had a bet on when it was going to happen,I think I wont.So im waiting on my lawyer to call so I can tell him whats going on and see what he has to say about the whole thing.So thats my book for the last couple of months and we will see what happens from here and im wondering what happens now with the ssdi case and if I have to start all over or what,im lost at this point on what happens next in the ssdi thing.thanks all see ya soon Scott aka hurt.Nothing to hide anymore and it feels good I just wish my body did as well.

You are allowed to appeal the decision made by Social Security Administration.
You must appeal by the deadline set my SSA.
If you win your appeal you will receive back pay to the date you applied.
If you start all over and reapply you will only receive back pay to the date you reapplied.
In our area if you are denied and appeal your paperwork goes to committee for reconsideration. The good thing about this is you do not have the wait of going before a judge. The committee takes a 2nd look at your medical documents.
The above recently happened to my friend, the injured RN. SSA sent her a list of the medical records they had, my friend saw that SSA did not have records from one of her doctors and submitted the records to SSA. My friend won her appeal and she now receives SSD.
In past years I was trained by Social Security Administration and worked as a volunteered to assist familied with children with disabilities apply for SSI. This was years ago under the Brian Zebley decision.
I have no choice do to the ltd was using there lawyers to handle my ssdi case and they said they were dropping my case.So untill my lawyer gets back from vacation I can talk with him about what they are doing or trying to do to me.they are trying very hard to get rid of me and they did send a pi to watch me i caught him and would do nothing so they would not say anything.So im stuck rite now on the ssdi thing.
I answered Your PM Hurt, but I just wanted to Post One thing Here for Others that May End Up in Your Situation with PI's and Evidence. If the Ins. Co. Claims that they have Film or Photos of You doing things Over Your Restrictions, that Info. HAS to be Shared with Either You (If Your not Represented) or Your Attorney, just as Medical Evidence has to be Shared. So if it were Me Hurt, and I have been Followed for Years Now, and not One Photo or Video Exists of Me Over My Restrictions, I would Make them Prove it by having Your Attorney Ask for the Evidence to Review for Possibly a Petition before a Hearings Judge, or a Mediator!! If the attorneys have already filed for your SSDI, just notify SSDI that your attorney has dropped your case and that further communications be with you and not them. Just because they dropped you, doesn't mean that they hadn't filed for you. If your SSDI claim has been filed, until such a time as you receive a denial letter, then I wouldn't worry much about it. Just call SSDI and make sure that the attornies filed. Otherwise, you will need to file for yourself.
My claim was filed on Wednesday by my LTD attorney firm. I am waiting for a call at this point in time, to get started on SSI/medicaid, which my lawyer says I am eligible for as I am now on a very low fixed income for 2 people (appx. 11,300 a year) and that is from LTD. which, like with you, at anytime, could offer me a buyout. Although they state that I will be covered through my birthday 2028 at which time I will be 62. I have just adopted a wait and see attitude on all things financial at this time, as there isn't any sense in making myself sick with worry.

They did file and im at hearing level and that's a long wait,so can I hire a new lawyer to handle where the left off?My lawyer has got back in the ssdi game and I can not talk to him until monday he is out of town on business.I have been in this ssdi game for over 1 1/2 years and another 12-18 months to get before the judge they tell me.It is tough in my state to get ssdi at my age they say with my education and back ground I can find a job thats why they keep not giving it to me.Every day it is getting harder to walk and do daily chores but they dont care,now if you are a drunk in my state they will give you ssdi but if you are hurt and need it because you can work you are out of luck and it is sad it feels like wc all over again.

I don't see why you couldn't get another lawyer to handle your SSDI. They would just have to request your file from the attorney that quit, and it wouldn't take them long to know where your SSDI claim stands. They would then notify SSDI that they are taking over your claim and all further contact should be with them, not your first attorney.
Of course, the first attorney will put a lein against your claim, and be able to get his money reimbursed from any and all back pay you are granted ( I believe the max they can get is $5300). So you would end up paying 2 attorney's, just as you would if you had changed attorneys' during your WC claim.
Whatever you do, DO NOT refile !!! This would put you back at square one with your claim and would jeopardize you getting anything. In the meantime, contact SSDI and let them know what is happening with your attorney. Let them know that until you are able to find another attorney to handle your claim, that you are to be directly contacted with any and all information in regards to your claim.
