Heres one for the pro's or someone who' knows.. I was injured in WI on Nov 2007 I was off work for a little over a year. They didnt have to but they kept my job for me well over fmla regulations. Now I went back to work Dec 2008 and have been working ever since does fmla rules still apply, if for some reason my DR would pull me out is my job still protected again. Just a thought I like to be a step ahead on this 1. It may perswade me to ask DR not to pull me off unless I would be damiging myself more.
I hope it still would, and would this be a new injury or since I'm still in pt for old 1.

Bronco.....I think that if you've worked 12 consecutive months FMLA is in effect again. I could be wrong. Try thier website. It's written very clearly.
This is all I know about it. Someone else may have more info. I'll try and see if I can find a better answer also.
To be eligible for FMLA leave, an employee must work for a covered employer and:
* have worked for that employer for at least 12 months; and
* have worked at least 1,250 hours during the 12 months prior to the start of the FMLA leave; and,
* work at a location where at least 50 employees are employed at the location or within 75 miles of the location.
I have a question, If Bronco did not use his FMLA for his injury, The law states he has to work 1,250 hrs or 12 months prior, which if he didn't use it then, can he use it now?.
You see I dont know if I used it, I did not sign nothing from company.
When I was injured a month later I woke up out of a self induced colma. My wife and employer took care of every thing.

I'm not sure I'd trust my employer and wife to do it together correctly!

I dont know what kind of remark or what you are tring to prove but not very proper, And if you must know......
1. Head on collision with a highway snowplow truck.
2. Shattered hip socket.
3. Broke pubic bone in half
4. Pelvis had fractured in many areas "open book pelvis fracture.
5. 14 broken ribs, and yes I said 14.
6. Punctured lung
7. Flatlined in ambulance
8. After ER visit they decided to ship me to different hospitol.
9. After they moved in to the second ambulance 2nd lung went.
10. Chest tube put in on way to hospitol.
11. Had fever so surgery was delayed so they figured they would induce me for the pain was intollerable. And was given propophil to forget medicine.
12. ended up with mrsa from chest tube went into blood stream.
13. had surgery with over 40 screws and a lot of plates which they wont remove.
14. Ended up with blood clots DVT'S in legs, Had IVC filter put in.
15. Had reaction to heparin and was bleeding internally and flat lined again and revived and had several liters of blood drained from abdomin. And 2nd chestube was put in.
And have lived in pain ever since and I continue to push on.
Now you tell me that I have not had to deal with enough agony in my life to have you say such smart ass remarks. Walk a mile in my shoes before you judge.

You said you were in a self induced coma. I think there was an attempt at humor. I believe you meant to say a medically induced coma.
