This took place in Charlotte, North Carolina. A lawyer purchased a box of very rare and expensive cigars, then insured them against, among other things, fire.

Within a month, having smoked his entire stockpile of these great cigars, the lawyer filed a claim against the insurance company.

In his claim, the lawyer stated the cigars were lost 'in a series of small fires.'

The insurance company refused to pay, citing the obvious reason, that the man had consumed the cigars in the normal fashion.

The lawyer sued and WON!

(Stay with me.)

Delivering the ruling, the judge agreed with the insurance company that the claim was frivolous. The judge stated nevertheless, that the lawyer held a policy from the company, in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable 'fire' and was obligated to pay the claim.

Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000 to the lawyer for his loss of the cigars that perished in the 'fires'.

NOW FOR THE BEST PART...

After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON!!! With his own insurance claim and testimony from the previous case being used against him, the lawyer was convicted of intentionally burning his insured property and was sentenced to 24 months in jail and a $24,000 fine.

This true story won First Place in last year's Criminal Lawyers Award contest...

Wink...now that is a good one. I especially as a nurse truly believe that lawyers run our country. If they are not getting paid on a particular issue, they just change the law so that they will get paid from a party with more money... strange...but it is so true... sounds strange I know, but having some experience with this very issue right now... and in my favor...lol Red

I just got 15 months worth of back bills from my attorney on my denied claim in the mail this afternoon... in total I will owe over 4 grand and will only be getting about 5 grand in all. But she can only take 25% of each check... I will end up owing her over 2900 when my checks end. And I can tell you this... it isn't coming out of my pocket. When she charges me $50 for a 12 line letter, and $75 for a 5 minute or less phone call .. that is totally outrageous. And until I get a full client file showing all of the calls, letters she supposedly sent me, letters she reviewed for my claim, etc. ... I am going to deny every attempt at settling my claim. I asked her for it 2 weeks ago, and have got nothing to show for what she supposedly did. On top of that, I am charging her for every fax she requested I send because she couldn't wait 2 days for the US mail to get them to her.

My Brother-in-Law is a Corporate Tax Attorney and CPA, along with a General Practice, and He told Me that Story also, it Surely is a Great One!!Smile He got what He Deserved in the End!!!Smile

UA, Here in Pa., We have to Sign a "Contingency Agreement" with Our Attorneys, and the Hearings Judge has to have a File on Copy, and Mine Clearly States that if We Lose, I Pay no Expenses at All. Do You have to have that Agreement in Your State? I know Some Attorneys will Charge as they Go, and Charge Expenses as they Incur them, but if Your Agreement States that You don't have to Pay, such as Mine, You May be able to Rid Yourself of those Expenses. Now when My Attorney Won the Very First Dime for Me, He gets 20% of My Pay Weekly, as His Fee, and 20% of any Lump Sum Settlements, or any Penalty Monies. I Just thought I would bring that to Your Attention, as I'm not Sure how things are Handled State to State! Best of Luck, and Have a Safe Trip!!Wink
