is it true that you have to be off work a week before you would get any compensation? This seems hard to believe since you are already hurt, you should not have to lose your pay also. I live in the state of Indiana, and know the law differs from state to state.
Tray, Welcome, and sorry to say but yes, It depends on your state and employer, In some cases it is 7 days, some may be more. Then you are paid from the time of your injury. You will also recieve only a percent of your wages. 66 2/3%
the waiting period is paid if it's a very serious injury with much lost time-how much depends on the state.
you can often use leave credits if the waiting period is not paid.
WC payments are non-taxable. Therefore the 2/3's of your regular pay is usually about the same as you would take home from your paycheck. My waiting period was 3 days, but since I was initially out about 9 days before returning to work, the entire 9 days was paid. Each time I've been off since, there's been no waiting period.

Hopefully your WC company is better than mine it has been 28 days since my injury and I still have not received any TTD benefits. It seems to be a hit and miss system. So good luck

The only problem with pay is overtime is not normaly figured into you WC pay. So if you work allot of extra you lose big time. I worked an average of 60 hours a week but WC would only pay based on 40. My yearly income was double my base so I've lost allot in pay over the years
Tray, your State needs to be known for futher information. Each State is different from the next as are the Work Comp Laws and Rules.

Indiana State Work Comp Laws and Rules;

Waiting Period:

When a compensable injury renders an employee unable to work, compensation for lost wages is paid starting on the eighth day. However if the employee is still disabled, on the twenty-second day after the injury, the employee will receive compensation for the first seven days. Ind. Code §22-3-3-7(a).

The first weekly installment of compensation is due fourteen (14) days after the disability begins. Not later than fifteen (15) days from the date that the first installment is due, the employer/carrier must tender to the employee an Agreement to Compensation, along with compensation due, or request an extension of time. Ind. Code §22-3-3-7(b).

If, however, the employer/carrier denies liability, a written notice of denial must be mailed within 30 days after the employer’s knowledge of the alleged injury. Ind. Code §22-3-3-7(b).
My TTD payments were based on my previous 13 weeks of employment which included overtime.
