I have posted on here before. I have a cervical herniated disc C5-6. Symptoms are neck pain, dizziness, headaches, pain in forearm, numbing and tingling in thumb and pointer finger, shocking feeling in mouth and tongue. I went to a w/c sports medicine Dr because w/c would not send me to a neurosurgeon. This w/c Dr was caught in many, many lies with my visits. He has returned me to work on light duty, put me in physical therapy, gave me an cervical epidural shot and tried many meds. Nothing has helped. Things seem to be getting worse. I went to a neurosurgeon on my own dime because I needed answers to why things were getting worse and not better. The neurosurgeon says I need surgery...an ACDF. He has advised me to NOT go to work under any circumstances, and to rest...rest....rest...until the surgery is performed. Workers Comp of course denied the claim because this Dr was not one of theirs. I have an appt with the W/C sports meds Dr in a few days. If he still releases me to work full duty is that malpractice with all the evidence he will have? I have a W/C attorney but they don't deal in malpractice. What should I do?
