I live in Texas and received temp income benefits for a job injury that happened in June 11,08. I was released with a clean bill of health on or about Aug '08 to return to work. So therefore my temp income benefits stopped. I did not know I had 90 days to write in a complaint that I feel the doctors findings were inaccurate or that I may have had some percentage of damage to my lungs. I hired an attorney in Jan '09 and was told that I could be reinstated my benefits since the doctors finding may not have been done fairly or that he was working for my employer. Or my chances slim to try and fight this and if they are why would my attorney tell me otherwise?
without knowing what evidence you have for either contention: unfair doctor finding or was working for employer, it is difficult to predict your chances.
what evidence will you give to the judge about the medical opinion?
