I am just opening a business in Texas. Primarily I will be distributing toilet accessories and toilet partitions.

I intend to subcontract the installation.

My full time employees are myself and a sales person.

Should I just get W/C to cover my sales person?

Do I need it to cover subcontracted installers?

What do I do if the installer does not have W/C? Hire them as a temporary employee?
you should discuss your insurance options with a local insurance broker. Workers compensation coverage is optional in Texas.
you also have exposure to unlicensed subcontractors as well as those without comp coverage. Liability in regard to independent contractors is determined on a case by case basis. Having a policy protects you any of those situations. Without coverage injured employee can bring civil suit for damages.

Like most things, finding coverage was a function of finding the right broker. Yesterday I was told getting WC would be very difficult.

Today I have 2 brokers with quotes.
Regarding subs without workers comp, apparently there is a form TWC 85 that I can have them fill out. From what I understand, it effectively gives them coverage provided by the state and keeps them off of my WC policy.

Thanks for the link.

The joys of self employemnt - you get to deal with all of the little details that your former employer had specialists for.

You know what helped? Your "get insurance" link. I got a call within about 10 minutes. They had a can do attitude.

Thanks.

And do they sell weed killer for those growing problems? Wink
