Full Version: Nephew hurt on the job.

My nephew works construction mainly masonary work. Until the construction picks up his employer has him clearing land on his employers property. So he gets his 40 hrs in but anyways he was cutting down tree and branch broke off and hit him in head he was nocked out and when he came to he was numb and couldnt move his neck. He called me since he was working alone and I told him to get to er. He told er he was working and who his boss was. he has broken bones in neck and in a neck brace, had ct scans and exrays. His employer says workmans comp wont cover it cause he was at his boss's home while working.
He is giving him a run around I think anyways, as long as he is on the clock and at a job site weather it be boss's house or a customers house he should still be covered.
Correct me if I'm wrong and says he has no paper work to fill out. I know I have read this before but cant remember it has been very stressfull. I saw a link where you can look up employers and who thier wc ic is and if yous could help me with this please I would be greatfull.
And yes we are from wi and any advice or info will help me better him with his fight. ....................Bronco
I would think that if he is getting the same paycheck from the same employer that it would not matter where he was working. If the employer does'nt want to cover it on WC then he better have a good homeowner policy, in fact your nephew may be better off going that route. I would think that if the employer cares enough for his employees to have them work at his house to get 40 hours that he would do the right thing here. Good luck to your nephew.

I thought of that too, I hope his employer does the right thing. My nephew is a lot like me, dont like to make waves. But darn it this is different I have talked to my sister and told her to be the agressor. And She made him an apointment with a good hospitol not our famous bandaid station we have here. If Employer dont come up with the solution tomorow my sister is making an appointment with lawyer as to who we should go after wc or home owners ins.
cival may be the better way to go...more money anyhow......have him ask his boss WC or cival suit will make a difference in which lawyer to get....

Your nephew's boss is simply trying to evade ANY responsibility...Boss know's it's probably his own household insurance that is going to have to pay for the injuries. He's probably thinking....YIKES, there goes my premimums through the roof!!!!
I too think homeowners insurance is the better of the two (WC).
I surely hope your nephew is ok in the end. Broken bones in the neck can be an everlasting and nasty injury

generally home owners insurance covers temporary employment in and around the property.
it's not so much a matter of whether he's covered or not but by which carrier.
have your nephew contact the employers home owner's insurance and file a claim with them.
I'm surprised the work comp carrier did not advise the owner of this.
Thanks everyone for the info. Even if he files for wc they will in return go after the homeowners ins, correct or no. I have not been able to get a hold of nephew this morning. Hopefully he has worked this out with his boss allready. I talked with him last night and he was still in a lot of pain they gave him oxxy but still is not cutting it. I will let you's know how it all unfolds. Thanks again.
