well my lawyer just called me they did file the appeal on the last day they could. i asked why and i was told they said i removed myself from the labor market and that im not as disabled as i think iam. as far as removing myself from the labor market i lost my job because i was unable to return to my full duty job that came from my dr and the ime,it was only the paid dr of my employer that of course said i can go back. i dont get where they have the right to say im not as disabled as i think iam? its the dr's that say im disabled not me. this whole thing has turned into a big joke and now i dont know what to do?
its their way of making you crazy........keep your cool and let them stew......kinda backfires on them tho when they dont do as the judge says...it ticks him off for the next time they have to go before him
Unfortunately, there is nothing you can do at this point but wait. If all the doctors other than the employer's doctor all said you can't work and the judge already ruled once in your favor, unless they have something new, the judge most likely will still rule in your favor. It's a shame that you have to go through this.
Blake, did you ever or were you ever asked to perform work rehab to find employment?

If so, make sure you keep a running log on a daily bases as to you showing a written record of search for work. Then hand it to your Attorney for the day they go to the Appeal Hearing.
well mi guess thats good i kinds figured it makes a judge mad. and yes its omly the joke of a dr the employer had that said any differnt,i really dont know what they could have that is new all my lawyer told me today was they said i voluntary pulled myself from the labor market which is not the case the judge already rulled on this once,i dont know where they get off saying that im less disabled than i think iam?so im probally looking at months again right?
at the last hearing i told the judge i was on some job search websites but its hard for me to find anything with my restrictions and the labor market the way it is. i mentioned to the judge i was looking into the vesid program i was supposed to go last month but i was unable to make it.i made a new apt today it falls every 3 tuesday of the month so i will be going for sure may 19th.
Yes Blake it could take some time. But the time frame is also on how fast every party can hook up also. Hopefully it's quick.

after my last testimony rverything was in my favor the judge was on my side 110% i should have know something would go wrong,i can only hope the judge sees it my way still she really has no reason not to. when it all comes down to it its all about the money they dont want to pay,hopefully i still win in the end in the mean time its gonna be very hard on me and my family

You were injured this time, which might be a reagravation of an older injury, with added damage in the year 2004. Is that correct?
Since I think it is correct, what have you and these doctor's been doing for all these years you claim to have been out of work?
When did your treatment stop?
When were you placed at MMI by any given Doctor?
This is 5 years, and you had no surgery. Something more has to have been going on?
yes i was injured in 2004 had the surgery and it went well until march 2008 there were post operative changes in the c5 c6 where i had the surgery. forminal narrowing and spurring,also they have found radiculopthy in the c7 c8 . i have have pt,pain manegment,pain meds.my dr has also said its cronic neck pain that i will always have. i was given mmi in dec 2008 by the ime but never my treating dr.i havent had any surgery since 2004.
