I wanted to give ya'll the update on what has been going on. As you all know I had an MRI in Dec. that showed I needed a 2 level lumbar fusion. Then was referred back to my neurosurgeon which I saw in Jan. and he reviewed my MRI films and also agreed I needed the surgery. He then sent me to a neurologist which did EMG/NCV studies and also told me I needed the surgery. He sent the results to my neurosurgeon and my neurosurgeon then sent me to an orthopedic which does the assisting with him when he does lumbar fusions. The orthopedic also stated I needed the surgery. Since around Jan. 23rd I have been awaiting WC to approve the surgery.

Last fall I had a new adjuster put on my case. She had been recieving all these reports regarding this surgery. She decided to send me for a 2nd opinion with an orthopedic that has never been on my case in the almost 10 years of my injury. In the past WC had been sending me to a neurosurgeon for my 2nd opinions. The adjuster made my appt, with this new doctor, the appt. date came up and the day before my lawyer called me to tell me the appt. had been canceled for me not to go. Then my lawyer began questioning me about this orthopedic the adjuster was wanting me to see. Lawyer asked if I had ever seen this doc since my injury. My reply was NO. Lawyer could not understand why they were not using the previous neurosurgeon that had been rendering the 2nd opinions in the past. My lawyer objected to this and proved to the adjuster the neurosurgeon that had been rendering the 2nd opinions and told her it was a doc they sent me to. Lawyer demanded she send me to that doc for my 2nd opinion and finally the adjuster agreed to make me an apppt. to see that doc. I have been waiting for this appt. for 2 months now and no appt. yet. I called my attorney and her assistant called me Monday. She stated I now have another new adjuster that just got my case. I said, I wonder what kind of *itch this one will be. I was actually told that she seemed to be on the ball. The new adjuster saw where I was awaiting a 2nd opinion appt. and she called the neurosurgeon to give the opinions office. Of course they want to be paid up front. The adjuster told my lawyer that she had mailed out the payment and when the neurosurgeon recieves it she will be making my appt. It should not take that long for him to receive the payment so maybe I will have an apppt. sometime soon.

God, I sure hope so because my pain level has me in the bed lately. At times the bed does not even help so I can't find a position where I can get relief. Tomorrow my sister and I are going to my lawyers office. She represents my sister also for her case. She will be seeing both of us tomorrow at 11am. I am going to discuss with her the time limit allowed by law for a decision by WC. If they are outside of that time period I will disuss her filing for the penalty. If they are wrong and out of the limit allowed by law, then I want the penalty. I have gotten penalty money once already and if I can get it again, I want it.

Please pray that something happens soon. My brain is so fried with pain and I know many of you are in the same condition. My prayer for all of you is that your days are not filled with too much pain and that you can somewhat function. God Bless all of you.

MJC...I am so sorry to hear about your pain levels and how difficult I know if must be to cope with it all. My prayers are with you sweet lady and I will keep you in my thoughts and in my heart. Please take care of YOU. Love Red
Well, thanks for the update MJC, but I am sorry to hear about the runaround you are getting. It's so typical in WC to get taken advantage of by adjusters who don't think you know anything. So keep up your fight and I hope it all ends with your needed surgery. The sooner the better.
Thanks everyone! I am all dressed waiting for my sis to finish dressing then we are off to lawyer. It is about and 1hr.45 min. drive for us. Will keep you guys posted on our trip. God

Made the trip ok but it was a very long day. When my lawyer walked into the lobby area to greet us and take us upstairs she went straight to the fax machine while greeting us. She told me, well this is something, you just walked in and this fax is about you. Comp finally made my appt. for the 2nd opinion with the neurosurgeon. It is May 18th and I am so ready. She spent over 2 hours with us. By accident she found out because the slip of my sisters tongue what SS was and is doing to me since I got my indeminity settlement. My lawyer was so upset she began to have a panic attack. She shared with us that she had developed this problem. She was so upset she could not think. She actually had to take her anxiety med. I really felt bad that I, well actually my sis sent her into a panic attack mode. SS has cut into my check or my settlement saying they have overpaid me $43,000 and for over a year now I been fighting this issue and I did not realize my WC lawyer was not aware of this until yesterday. She was calling my SS lawyer yesterday because she was so upset at what they are trying to do to me. She is going to look at the penalty regarding their delay and they are outside of the time allowed by law. But she will not look into this until aftet I have my 2nd opinion doctor appt. I told her I agreed with that totally. She did say she was going to offer them to waive the attorney fees for this as long as they pay me the penalty. If not then she will charge them. Our visit was long and she was dedicated to giving us all the time my sis and I needed. My sisters things are going well also and WC is negotiating with our lawyer real good. All in all our visit was a positive one but I still feel bad about her panic attack regarding the news about my SS. That is my update and I hope this finds all of you having as much of a pain free day as possible. God Bless and love ya'll.

MJC....I certainly hope your new WC adjuster is Heaven sent, and she can get the ball rolling....and IS on your side for a change!!!

Hang in there girlie, I know the pain must be immense...but i also know that you are strong. I pray they get you to the doc swiftly...You are in my prayers nightly!

MJC My Friend, I know You have been through a Lot Lately, and I will Pray that all Goes Well at Your Appt. with the Dr.!! I am not Up on the Laws of Your State, but as You know I don't Usually give Money Figures on Here, but with All of the Problems and Intentional Delays the Ins. Co. for My Employer has Made, My Attorney has been able to get Me so Far, $11,000.00 in Penalty Money alone, and I am going for More the Appeals Board is giving Me this Month, as a Part of My Mandatory Settlement Meeting!! I Hope You get Every Dime You Deserve!! The Only Way to get these Ins. Co.'s to Move Sometimes is to Hit them in the Pocket!! Best Of Luck!!Smile
