I wanted to give ya'll the update on what has been going on. As you all know I had an MRI in Dec. that showed I needed a 2 level lumbar fusion. Then was referred back to my neurosurgeon which I saw in Jan. and he reviewed my MRI films and also agreed I needed the surgery. He then sent me to a neurologist which did EMG/NCV studies and also told me I needed the surgery. He sent the results to my neurosurgeon and my neurosurgeon then sent me to an orthopedic which does the assisting with him when he does lumbar fusions. The orthopedic also stated I needed the surgery. Since around Jan. 23rd I have been awaiting WC to approve the surgery.
Last fall I had a new adjuster put on my case. She had been recieving all these reports regarding this surgery. She decided to send me for a 2nd opinion with an orthopedic that has never been on my case in the almost 10 years of my injury. In the past WC had been sending me to a neurosurgeon for my 2nd opinions. The adjuster made my appt, with this new doctor, the appt. date came up and the day before my lawyer called me to tell me the appt. had been canceled for me not to go. Then my lawyer began questioning me about this orthopedic the adjuster was wanting me to see. Lawyer asked if I had ever seen this doc since my injury. My reply was NO. Lawyer could not understand why they were not using the previous neurosurgeon that had been rendering the 2nd opinions in the past. My lawyer objected to this and proved to the adjuster the neurosurgeon that had been rendering the 2nd opinions and told her it was a doc they sent me to. Lawyer demanded she send me to that doc for my 2nd opinion and finally the adjuster agreed to make me an apppt. to see that doc. I have been waiting for this appt. for 2 months now and no appt. yet. I called my attorney and her assistant called me Monday. She stated I now have another new adjuster that just got my case. I said, I wonder what kind of *itch this one will be. I was actually told that she seemed to be on the ball. The new adjuster saw where I was awaiting a 2nd opinion appt. and she called the neurosurgeon to give the opinions office. Of course they want to be paid up front. The adjuster told my lawyer that she had mailed out the payment and when the neurosurgeon recieves it she will be making my appt. It should not take that long for him to receive the payment so maybe I will have an apppt. sometime soon.
God, I sure hope so because my pain level has me in the bed lately. At times the bed does not even help so I can't find a position where I can get relief. Tomorrow my sister and I are going to my lawyers office. She represents my sister also for her case. She will be seeing both of us tomorrow at 11am. I am going to discuss with her the time limit allowed by law for a decision by WC. If they are outside of that time period I will disuss her filing for the penalty. If they are wrong and out of the limit allowed by law, then I want the penalty. I have gotten penalty money once already and if I can get it again, I want it.
Please pray that something happens soon. My brain is so fried with pain and I know many of you are in the same condition. My prayer for all of you is that your days are not filled with too much pain and that you can somewhat function. God Bless all of you.
