Full Version: I don't have a clue...

I;ve never done this before and my claim was just denied. I was told to write a cover letter and send the denial letter with it to workers comp but no one told me what kind of info to put in this cover letter. I am going to be out of work for quite a while and need to get this right. Can anyone help this poor old gimp out?

Hi, welcome to the forum. What state are you from? What do you mean by denied ? Explain the contents of the letter. Someone with the answers to your question should be along shortly after you post your state. Keep checking back. If it were me, i would consult with a workers comp attorney in your area. For info on workers comp in your state , click on the state info site located on the top of this page. Once you locate your state click on the " for employees " site.
who denied your claim? who are you to write to? there are a lot of different parties in the claims process and "workers comp' could be anyone from the judge to an adjuster .
you need to be more specific.
The Clues are endless till you fill us in with more information as suggested from the others here at this board.

I live in Oregon. My Workers comp was denied by my workers comp insurance (Esis inc.) after four months of being on it and being seen by their independent medical examiners. The odd thing is that their IME actually confirmed the re-injury at work. The letter simply stated that my claim was denied due to it being a new injury and that I had to file for a hearing with workers comp. and that I needed to send a copy of the denial letter along with a cover letter to the state workers comp board. I was injured at work in August of '07 and had been on lite duty ever since my surgery. The surgery was on the disc between C-5 and C-6. Last February my restrictions had only moved up to lifting, pushing, and pulling up to 50 lbs. . My new manager wouldn't comply with restrictions and had me moving 1700 to 2500 lb servers on to pallets. I not only re-injured that disc but the disc's between C-4 and C-5 and C-6 and C-7 as well. I go into surgery to fuse from C-4 to C-7 on June 8th. That's all of the info. I have at this point. Don't really know what else to do from now on. Getting an attorney but before he meets with me, he want's all of the reports from every party involved and its going to take some time but I only have so long to get this cover letter and denial letter to W.C.
Any ideas?

Your attorney should beable to file for the hearing . God knows it takes month to get one. Or file for a hearing on your own and possibly your attorney should be ready by then .
Hi and Welcome to the Forum!! I can Understand an Attorney wanting Info., but if they know You are on a Short Time-Line and want All the Info. before Deciding on whether they want You for a Client or not would Make Me want to Look at a Few More Attorneys!! You should have enough Info. to give an Attorney that would give them a Good Idea of Your Case, and should be able to File Your Appeal for You, and then get the Rest of the Info. Later! Just My Opinion, but I would be Looking for an Attorney that's Ready to Act for You!!Wink
Yeah, that's funny... they want the request tomorrow but don't give you the hearing for months. I actually am starting to look for another attorney right now. I met with this guy yesterday and he isn't going to except the case until he see's all of the reports because he says he won't take on a losing case. He seems to know what he's talking about but I am still leery. He reminds me of a combination of Denny Crane and his best friend on "Boston Legal". A little prejudice of my Surgeon as well because he's Arabic. That threw me off as well. My surgeon is one of the leading Dr.'s in Oregon.
Just a Quick Thought for You to Consider: If You have ANY Doubt in Your Mind at All about an Attorney You Meet with, Do No Hire Them!! It will being doing Both of You a Favor, because You will always have Doubt in the Back of Your Mind, and the Attorney will Tire of You Second Guessing them. Find Someone You "Click" with, You are going to have them in Your Life for a Good While, and both have to be on the Same Page to be Successful!! Just My Opinion, but I did as I've Written, and have Never Doubted My Attorney's Decisions. We have Debated many, but when Push Came to Shove, We have always been able to Come to Common Ground!!Wink
did you file a new claim on the re-injury? work comp is event driven: all benefits have to be connected to an injurious event. interveneing non-industrial or industrial injuries may stop coverage of an existing claim.
the medical reports supporting the carriers decision should have been filed with your atty and would explain the issue better. ask to see them so you can get your questions answered.
