my contract was not renewed to return to my place of work for next fall. i have been on medication for hypertension but am now having all sorts of problems with stabilizing it as a result of not being renewed. does wc apply to aggravating a preexisting condition? does it depend on the state?
yes aggravations are considered new injuries.
yes laws and legal decisions are state specific. i don't know of any the don't have some provisions for aggravations.
Your Thread heading subject is (unlawful termination). A contract renewal has nothing at all to do with a work comp claim.
I assumed the poster was asking whether comp recognizes the aggravated Hypertension from the termination event as a claim.
I suspect the aggravation issue might not be as big a the injury or the termination facts.
I understand 1171, but I too am treated with Hypertension. The thing is, if you Fart wrong, it can cause it to act up. If the Sky was said to be Blue by the Weather man, and it's not Blue, it can set it off. When a person has hypertension, they just need to deal with every day issues as they fall into place. A simple issue of a contract not being re-newed 5 to 6 months in advance isn't a issue just causing their hypertension to flare up by it's self, but more lack of control, on trying to figure out where their next job will be is all.
Does the Poster have high cholesterol?
Does the Poster have primary or secondary Hypertension?
Does the Poster have any Relatives with High Blood presure or Hypertension?
Does the Poster have a problem with being obese?
Does the Poster live under a proper controled diet?
Does the Poster limit their sodium intake?
Does the Poster have a Body mass index greater than 25?
Does the Poster have a vitamin D deficiency?
Hypertension, is known to be inherited.
All of these issues, and many, many more would all have to be taken into account, before one can even think of trying to make a simple upset, a Work Comp issue is all I am saying.
I dont know, I think if it were that easy WC would be broke. Im sure with the stress it can flare it up but who's to say. If I eat potato chips lets say lays and have a burger with season salt. 1 to 2 hours later my heart is racing and blood presure goes up. And yes I do have all the issues bbbb posted maybe not the vitamin D thing.
Bronco, then I can say you know where I am coming from? 1171 about said the same in other words also. As we know, if you don't get a handle on issues, simple anger, a simple upset, someone cuts you off slightly on the road, or your candy bar only had 10 peanuts in it instead of the required 11 peanuts, can flare up ones Hypertension. And like you stated, even a simple fast meal can flare it up, or even a soda, or some coffee brands.
In my opinion, it's not an issue of a work comp claim.
I can understand a person never having it, and after an injury, and certain medications, that can cause it to come into play, then Hypertension related to a work injury could be accepted.
I just thought it to be a little proper to explain Hypertension being treated prior anything in a work relation, to the readers here on this board.
