Full Version: Should you hire an attorney?

Hello. I have never dealt with workers comp before, and I have to say I am very frustrated with the whole process. I fell on ice walking into work. Intitially my wrist was sore, I figured it would go away. But I reported the fall that day. That was not quite 6 months ago. I have been diagnosed with DeQuervain's and possible carpal tunnel, my hand hurts so bad that it has made it impossible to do my job, and my co-workers have had it with me. I finally gave in and told my Doctor I couldn't do it anymore, between the dull pain going to the shoulder combined with the muscle spasms and sharp pain, working is aggravating the whole situation. First does workers comp apply when you are not punched in to work? And why is a company from California setting up appointments for a New York workers comp case and taking forever because they tried sending me an hour and a half in the other direction. Thanks for any info you can provide.
it can be comp if there are special circumstances. commuting to/from work is excluded.
I'm guessing the employer is not restricted to contracting with in-state companies.

I was walking from parking lot up walkway to door when I slipped and fell. How does that work? I had not started work yet.

well since you were not clocked in you may not be covered on WC however a cival suit may be possiable and better for the $$$$$$$$$$$

situations like yours are very caselaw dependent; there is no one answer. it may depend on whose walkway it is or who was responsible for maintaining it.
there are cases where off-clock activity has been covered by comp.
