Full Version: can there be lapse between TD and PD? CAL.

Treating dr says P&S unable to return to usual job, 3/9.
Lite duty work ended 3/11/09.
(AME on 4/9/09, concurs.)
Now I have no income from lite duty. Have not heard from the adjuster about temp payments or perm payments.
Lawyer says there will be no payments from w/c until the AME report is done and released which could take 60 days.
Question: can there be a lapse between temp disability payments and perm. payments? I was getting a supplemental TD check from w/c while on lite duty.
Lawyer says to file for state disability in the interim. SDI won't pay since I am released by the dr.

ANY IDEAS?? HELP!!

I'm Assuming that Cal. means California, and I'm Sorry I don't even Venture Guesses about Ca., Their System is More Complicated than Mine in Pa.!! I'm Sure Someone will be along with Info. from Your State, and I Wish the best for You!!Wink
there can be a gap when they don't know if or how much pd there will be. if you are Permanent and stationary then you should file for unemployment. unless you are looking for total disability your PD will not be enough to live on and you will have to get a job within your restrictions.
if your atty is a workers compensation specialist trust their knowledge of the rules.
The says the carrier is to make reasonable advances on your PD until the amount is known. your case may not make it possible to determine what's reasonable.
