i have been turned down for my unemployment because it says i voluntary quit my job because i felt i was stll unable to do my job.i was released by the companys dr of choice but not my dr which the workers comp judge agreed with and told ins comp to continue payments. i recived multiple letters from my emplyer clearly saying i was terminated. the letter from the labor dept said my quit is deemed for personal and non compelling reasons. now my employer is clearly lying and was caught doing so by the workers comp judge . do i have a case here? for my hearing will the letters be enough to prove so?
I don't have an answer, but I too am in New York and approaching the end of my FMLA and don't know if I will be back before that date. I hope it all works out for you.
you should bring your workers comp paperwork as well as the judges findings and you doctors authorization to be off. copies of your comp checks for the time off to prove it was approved by comp.
